2.7. The Judge shall recognize the agreement of the parties at the appellate trial

  • Main tasks and practical skills:

    • When explaining rights and obligations to the litigants, the Trial Panel should explain to the litigants the right to reach an agreement with each other at any time during any proceeding process and the benefits of such agreement.
    • Where the parties reach an agreement, the Trial Panel shall request the parties to reach another agreement about payment of the court fee for the hearing of first instance.
    • Where the parties cannot reach an agreement on payment of the court fee for the hearing of first instance, the Trial Panel shall decide in accordance with laws.
    • Where the parties reach an agreement on the resolution of the case, the Appellate Trial Panel must render an appellate judgment which corrects the judgment of first instance, recognizing the agreement of the parties.
