2.8. Order of presentation and oral argument at the appellate trial

  • Main tasks and practical skills:

    The order of presentation at the appellate trial shall be as follows:

    • Where only one of the litigants appeals, the person defending the legal rights and obligations of the litigant shall present their opinions first, then the litigant shall provide additional opinions.
    • Where both litigants appeal, the person defending legal rights and obligations of the plaintiff shall present their opinions first, then the plaintiff shall provide additional opinions. Next, the person defending the legal rights and obligations of the defendant shall present their opinions, then the defendant shall provide additional opinions.
    • Where there is an appeal and a protest, the appellants shall present their opinions according to the above order, then the representative of the Procuracy shall address the protest.
    • Where only the Procuracy protests, the Procurator shall present the contents of the protest and grounds for such protest.
    • The order of oral argument shall be the same as the above mentioned order.
