4.1.3. Prescription


Being a contractual relation, a housing purchase contract also has the same prescription for requesting dispute resolution as other contractual relations. In addition, it applies separate provisions on prescription.

    Note that the Judge must apply legal provisions effective at the time of a particular transaction, as follows:

    • Before 1 July 1991, there was no provision on applying prescription for initiating a legal action.
    • From 1 July 1991 to 1 July 1996, Article 56 of the Ordinance on Civil Contracts was applied the prescription shall be three years from the date when the dispute occurs if the contract is not invalid).
