1.2. Position and role of the People’s Courts in the State apparatus


  • In the Socialist Republic of Vietnam, the organization of the State apparatus is based on the principle of power centralization with clear separation and dissemination of powers among State bodies in conducting the three authorities: legislative, administrative and judicial. Conducting the judicial authority, mainly the authority to adjudicate cases and matters, is one of the most important functions of the State of Vietnam and is assigned to the People’s Courts. The People’s Courts, therefore, play a critical role in the State apparatus.
  • The Courts play a central part among judicial bodies. Resolution No. 49-NQ/TW of the Politburo dated 02 June 2005 on “the Judicial Reform Strategy towards 2020” states,: “to  re-organize judicial bodies and judicial assistance institutions so that these bodies and institutions have logical, model and scientific structures, work conditions and facilities; among these bodies and instutition, the court  and adjudication activities are the focus of the re-organization”.
  • The Supreme People’s Court, local People’s Courts, Military Tribunals and such other courts as are stipulated by law shall be the judicial bodies of the Socialist Republic of Vietnam.
  • The People’s Courts play an important role in protecting political security, social order and safety, creating a stable environment for economic development, international integration, building and protection of the Fatherland.
  • The People’s Courts support the People in protecting justice, human rights; and uphold the law and the socialist rule of law, effectively struggling against types of crime and violation.
