1.3.1. Procedure for commencement of the trial

  • Main tasks and practical skills:

    • Before the opening of the trial, the Court Clerk should disseminate the court rules, and check whether persons summoned to the trial are all present and identify reasons for any absence.
    • When the Trial Panel enters the court room, all the people present have to stand up, and the presiding Judge shall open the trial and read out the decision on bringing the case to trial.
    • After reading the decision on bringing the case to trial, the presiding Judge shall request the persons present to sit down and the Court Clerk to report the list of persons present upon summons, and identify reasons for any absence.
    • The presiding Judge shall check identity cards of the litigants, and explain to them and other persons participating in the proceedings their rights and obligations (as provided in the corresponding articles of Chapter VI of the CPC).
    • The Judge shall resolve requests for replacement of the persons conducting the proceedings, examiners, or interpreters.
    • The Judge should consider and decide the adjournment of the trial when there is a person absent.
    • The Judge should consider and  use relevant orders to prevent  witnesses and other people  from hearing each other’s testimonies and communicating with persons concerned.
