7.1. Determine jurisdiction with respect to a decision on such extenuation or remission

  • Main tasks and practical skills:

    After being assigned to consider remission of sentence or exemption from serving sentence, the Judge should:

    • The Judge should check which type of penalty is imposed on the person subject to the request for such remission or exemption .
    • Pursuant to Item 1 of Article 269 of the CrPC, the Judge should determine whether such remission or exemption falls under the Court’s jurisdiction .
    • The remission or exemption applicable to a fine or court fee must be in accordance with jurisdiction as provided in Section 3 of Part II of Inter-Circular No. 02/2005.
