4.1.1. The Judge shall determine which laws apply to a juvenile offender

  • Main tasks and practical skills

    • When the accused is a juvenile, the procedure for dealing with them shall be in compliance with the provisions of Chapter XXXII of the CrPC. If both Chapter XXXII and other chapters of the CrPC regulate the same issue in a contradictory manner, the provisions of Chapter XXXII shall prevail. If Chapter XXXII does not regulate such issue and other chapters do, the provisions of other chapters shall apply.
    • The application of the provisions of the CrPC is based on the age of the accused at the time when the proceedings are conducted. The application of the provisions of the Penal Code is based on the age of the juvenile offender when they committed the offence.
