1.3.5. The Judge should question each litigant about each issue

  • Main tasks and practical skills:

    • The presiding Judge shall have the first priority, followed by the People’s Assessor, then the person protecting lawful rights and interests of the litigants, the litgants and other persons participating in the proceedings; where a Procurator participates in the trial, the Procurator shall conduct the questioning after the litigants.
    • Where there are different plaintiffs, each plaintiff shall be questioned separately. The plaintiff shall be questioned only about the issues which the person protecting lawful rights and interests of the plaintiff or the plaintiff has not presented clearly, or which contradict each other or their prior testimony.
