1.3.3. The Judge should ask whether the litigants have any request

  • Main tasks and practical skills:

    • The Trial Panel shall accept any change in or supplement to the request of the litigant, if such change or supplement falls under the scope of the initial petition for initiation of a legal action.
    • Where the litigant withdraws the whole or part of the petition on a voluntary basis, the Trial Panel shall accept and suspend the hearing of the whole or part of the petition withdrawn by the litigant.
    • Where the plaintiff withdraws the whole of the petition for initiation of a legal action but the defendant still keeps the counter-claim, the defendant shall become the plaintiff and the plaintiff shall become the defendant.
    • Where the plaintiff withdraws the whole of the petition for initiation of a legal action and the defendant withdraws the whole of the counter-claim, but the person having related rights and obligations still keeps the independent claim, the person having related rights and obligations shall become the plaintiff and the person having obligations with respect to the independent claim shall become the defendant.
