3.3.3. Provisions on part of a will be legally ineffective

  • Main tasks and practical skills:

    • An individual may make a will to dispose of his or her property (Article 634 Civil Code 1995, Article 631 Civil Code 2005). Hence, the disposion of another person’s property in the will shall be illegal. The common situation of this case is the husband or wife making a will to dispose common property.
    • Heirs are, notwithstanding contents of wills as provided in Article 672 Civil Code 1995, Article 669 Civil Code 2005 (compulsory inheritance):
      - Children who are minors, father, mother, wife or husband of the testator;
      - Children who are adults, but who are incapable of working.
    • Other cases as provided in Article 670 Civil Code 1995 (Article 667 Civil Code 2005).
