10. Declaring the enterprise or cooperative bankrupt under special circumstances.

  • Bankruptcy Law (Article 87)

  • Main duties and practical skills:

    • After notifying and fixing time limit for the owner of the enterprise or legal representative of the enterprise or cooperative to pay bankruptcy fees in advance, and if the owner of the enterprise or the legal representative of the enterprise or co-operative does not have the monies or other assets with which to make advance payment of the bankruptcy fees, the court shall issue a decision declaring that the enterprise or co-operative is bankrupt.
    • In order to issue a decision on declaring the enterprise or cooperative bankrupt under these circumstances, the Judge must request the enterprise or cooperative to report about its actual status.
    • The report must be made in accordance with law (authenticated or notarized on demand).
    • Before issuing the decision, the Court must post in a newspaper the status of the enterprise or cooperative which shall be declared bankrupt.
