4.3. Procedure for questioning at the trial


Main tasks and practical skills

  • Before starting the questioning, the Judge should facilitate the parties to reach an agreement on resolution of the case. If the parties fail to reach such agreement, the Judge shall start questioning.
  • The Trial Panel shall determine fully all the details of the case by listening to the petitioner, petitioned, persons having related rights and obligations or representatives of the litigants, persons protecting legal rights and interests of the litigants, witness, examine and compare these opinions with collected documents and evidence in order to resolve the case.
  • After listening to the presentation of the litigants, the questioning of each person on each issue shall be conducted by the presiding Judge first, People’s Assessors later, and then the Procurator, persons protecting legal rights and interests of the litigants and other persons participating in the proceedings.
