2.3.3. Responsibilities of Judges

  • Main tasks and practical skills:

    • Judges shall have the duty to study and undertake research to improve their adjudicatory skills (Article 14 of the Ordinance on Judges and Assessors of the People’s Courts).
    • Judges must respect the people and shall be overseen by the people (Article 10 of the Ordinance on Judges and Assessors of the People’s Courts; Item 1 of Article 13 of the CPC; Article 32 of the CrPC).
    • Judges are accountable before the law for performing their duties and exercising their powers; and they may be subject to disciplinary measures or criminal charges if found to be violating the law, depending on the seriousness and nature of the violation (Article 6 of the Ordinance on Judges and Assessors of the People’s Courts; Item 2 of Article 13 of the CPC; Article 12 of the CrPC).
    • Judges must keep State secrets and work-related secrets in accordance with provisions of law (Article 7 of the Ordinance on Judges and Assessors of the People’s Court).
    • Judges shall be exemplary in the observance of the Constitution and law, live a healthy life, respect social principles, and participate in the propagation and dissemination of law (Article 13 of the Ordinance) on Judges and Assessors of the People’s Courts.
    • If a Judge in, the course of performing their duties or exercising their powers causes damage, the Court where the said Judge sits shall be liable for compensation and the Judge who causes the damage shall be liable to reimburse the Court in accordance with law.
