Promulgating the Regulation on inspection of quality, technical safety and environmental protection in the manufacture, assembly and import of motorcycles and motorized three wheelers used for the disabled

THE MINISTER OF TRANSPORT

Pursuant to the June 29, 2001 Law on Road Traffic;

Pursuant to the Government's Decree No. 179/2004/ND-CP of October 21, 2004, prescribing the state management of product and goods quality;

Pursuant to the Government's Decree No. 34/2003/ND-CP of April 4, 2003, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

At the proposal of the director of the Science and Technology Department and the director of the Vietnam Register,

DECIDES:

Article 1.- To promulgate together with this Decision the Regulation on inspection of quality, technical safety and environmental protection in the manufacture, assembly and import of motorcycles and motorized three wheelers used for the disabled.

Article 2.- This Decision takes effect 15 days after its publication in "CONG BAO."

Article 3.- The director of the Ministry's Office, the Chief Inspector, the directors of departments, the director of the Vietnam Road Administration, the director of the Vietnam Register, directors of provincial/municipal Transport Services (Transport and Public Works Services), heads of agencies and organizations, and concerned individuals shall implement this Decision.

REGULATION ON INSPECTION OF QUALITY, TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION IN THE MANUFACTURE, ASSEMBLY AND IMPORT OF MOTORCYCLES AND MOTORIZED THREE WHEELERS USED FOR THE DISABLED

(Promulgated together with the Transport Minister's Decision No. 03/2008/QD-BGTVT of February 22, 2008)

Chapter I

GENERAL PROVISIONS

Article 1.- Scope of regulation and subjects of application

1. This Regulation provides for the inspection of quality, technical safety and environmental protection in the manufacture, assembly and import of motorcycles and motorized three-wheelers directly operated by the disabled.

2. This Regulation applies to establishments that manufacture, assemble or import motorcycles and motorized three wheelers used for the disabled (collectively referred to as vehicles) and agencies and organizations involved in the testing, inspection and certification of quality, technical safety and environmental protection of these vehicles.

3. This Regulation does not apply to:

a/ Vehicles which were put to use before January 1, 2008, specified in the Regulation promulgated together with the Transport Minister's Decision No. 62/2007/QD-BGTVT of December 28, 2007;

b/ Vehicles which are manufactured, assembled or imported for defense or security purposes.

Article 2.- Interpretation of terms

In this Regulation, the terms below are construed as follows:

1. Unloaded vehicle is a vehicle ready for operation with the following devices:

a/ Fuel: The fuel tank is filled to at least 90% of its capacity as prescribed by the manufacturer;

b/ Auxiliary devices supplied by the manufacturer which are necessary for the normal operation of a vehicle (tool kit, props, windshield and protection devices);

2. Fully loaded vehicle is a vehicle in the state of carrying the maximum load with which it can operate normally as notified by the manufacturer and determined according to Vietnam standard TCVN 7363: 2003.

3. Manufacturing establishment is an enterprise that manufactures or assembles motorcycles, motorbikes or their accessories and satisfies material and technical conditions under current regulations.

Chapter II

REGULATIONS ON INSPECTION

Article 3.- Technical requirements upon inspection

1. General requirements

a/ Vehicles may be fitted with thermal or electric engines. If thermal engines are used, their cylinder capacity must not exceed 125 cm3.

b/ Wheels must be symmetrical to each other by the vehicle's horizontal median plane.

c/ The vehicle's largest dimensions must not exceed 2.5 m in length, 1.2 m in width and 1.4 m in height.

d/ The proportion of weight distributed on the guide shaft to the vehicle's unloaded weight and full loaded weight must not be less than 18%.

e/ The vehicle's maximum climbing ability must not be less than 7o (equivalent to 12%).

f/ The vehicle's angle of lateral static stability in the unloaded state must not be less than 25o.

g/ Fuel or lubricating oil does not leak at joints of components and systems fitted on the vehicle such as engine, clutch, gear box, transmission system, fuel tank, carburetor and fuel pipes.

h/ Parts which may come into contact with the driver and other passengers must not be pointed. The vehicle's protruding parts must satisfy requirements specified in Vietnam standard 6999: 2002.

i/ Screw joints, after being assembled, must be securely tightened. The tightening force of screw joints of important details must comply with technical documents issued by the manufacturer for each specific type of vehicle.

j/ The vehicle must show a symbol indicating that it is intended for use by the disabled at a noticeable position.

2. Controlling structure

a/ The vehicle's controlling structure must be suitable to the movement system of the disabled person who operates that vehicle; other controlling structures must satisfy the requirements specified in Vietnam standard TCVN 5929: 2005 or relevant national technical regulations like ordinary motorcycles or mopeds.

b/ The vehicle's controlling structures must be firmly fitted and easily operated.

3. Engines and transmission systems

a/ The vehicle's engine and transmission system must satisfy requirements specified in Vietnam standard TCVN 5929: 2005 or relevant technical regulations like ordinary motorcycles or mopeds.

b/ Exhaust pipe:

- The discharge hole must be designed so that the exhaust gas jet does not directly affect other traffic participants.

- The exhaust pipe must be arranged so that the vehicle and luggage cannot catch fire from the exhaust pipe and exhaust gas; and does not affect the braking function of the brake structure and electric and fuel systems.

4. Wheels and tires

a/ Wheel rims must satisfy the requirements specified in Vietnam standard TCVN 7234: 2003, Vietnam standard TCVN 6443: 1998 or relevant national technical regulations.

b/ Tires must satisfy the requirements specified in Vietnam standard TCVN 5721-2: 2002, Vietnam standard TCVN 6771: 2001 or relevant national technical regulations.

5. Brake system

a/ The brake system-controlling structure must be suitable to the movement system of the disabled person who operates that vehicle.

b/ The vehicle's brake system must satisfy the requirements specified in Vietnam standard TCVN 5929: 2005 or relevant national technical regulations like ordinary vehicles.

c/ Brake effect upon on-road testing

- Brake-testing conditions: An unloaded vehicle fitted with equipment and devices necessary for brake testing; the driver's weight of 75 kg; the road used for testing having a flat and dry concrete or asphalt surface.

- Brake effect: For vehicles of an engine capacity of less than 50 cm3 or a maximum speed of less than 50 km/h, the braking distance for the speed of 20 km/h must not be longer than 4 m. For vehicles of an engine capacity of 50 cm3 or more or a maximum speed of 50 km/h or more, the braking distance for the speed of 30 km/h must not be longer than 7.5 m.

- The vehicle's parking brake system must be able to stop the fully loaded vehicle on slopes of 7o up or down (equivalent to 12%).

d/ Brake effect upon conveyor testing

The testing of the brake on a conveyor is applied to vehicles to be released from factory.

- The total braking force of the main brake system in operation must not be less than 50% of the vehicle's weight (including the driver's weight) in a test.

The disparity in the braking forces of the left wheel and right wheel on the same axe must not be higher than 24%.

The braking force disparity is calculated as follows:

Braking                 PL - PN
force       =           --------- x 100%
disparity                   PL

In which PL and PN are the braking forces of two wheels on the same axe and PL > PN.

- The total braking force of the vehicle's parking brake system must not be less than 20% of the vehicle's weight (including the driver's weight).

6. Lighting, signaling and steering systems

The vehicle's lighting, signaling and steering systems must meet the requirements specified in Vietnam standard TCVN 5929: 2005 or relevant national technical regulations like ordinary motorcycles and mopeds.

7. Rear-view mirrors

a/ Vehicles of a cylinder capacity of less than 50 cm3 or the maximum speed of less than 50 km/h must be installed with at least one rear-view mirror on the left of the driver. Vehicles of a cylinder capacity of 50 cm3 or more or the maximum speed of at least 50 km/h must be installed with two rear-view mirrors on both sides of the driver.

b/ Rear-view mirrors must satisfy the requirements specified in Vietnam standard TCVN 6770: 2001 (except the requirements on the installation of rear-view mirrors on vehicles).

c/ Rear-view mirrors must be firmly installed so that the driver can easily adjust them at his/her seat and can see objects at least 50 m from both sides behind.

8. Odometer

The vehicle's odometer must satisfy the requirements specified in Vietnam standard TCVN 5929: 2005 or relevant national technical requirements like ordinary motorcycles and mopeds.

9. Seats and luggage racks

a/ The vehicle can have a seat for one passenger.

b/ Seat cushions must be firmly installed.

c/ Luggage racks must be firmly designed and installed.

d/ The vehicle is installed with racks which can firmly hold crutches and a wheelchair.

e/ The designed weight of luggage must not exceed 10 kg (excluding the weight of crutches and a wheelchair).

f/ The vehicle is not installed with any passenger or cargo carriage.

10. Fuel system

The vehicle's fuel system must satisfy the requirements specified in Vietnam standard TCVN 5929: 2005 or relevant national technical regulations like ordinary motorcycles and mopeds.

11. Chassis and shell

a/ Chassis must be hard, durable and easy to be assembled with other details and parts.

b/ Chassis must be coated with anti-rust paint.

c/ Chassis and shell must be firmly designed and installed.

12. Electricity system

a/ The accumulator capacity of a vehicle using an electric engine must be sufficient for the vehicle to continuously operate on a road at least 40 km.

b/ The vehicle's electricity system must satisfy the requirements specified in Vietnam standard TCVN 5929: 2005 or relevant national technical regulations like ordinary motorcycles and mopeds.

13. Requirements on environmental protection

a/ The vehicle's exhaust gas must satisfy Vietnam standards equivalent to Euro 2 or higher level.

b/ The maximum permitted noise level when parking must satisfy the requirement specified in Vietnam standard TCVN 6436: 1998.

Article 4.- Inspection of manufactured and assembled vehicles

The inspection of manufactured and assembled vehicles complies with the Transport Minister's Decision No. 58/2007/QD-BGTVT of November 21, 2007, promulgating the Regulation on inspection of quality, technical safety and environmental protection in the manufacture and assembly of motorcycles and mopeds.

Article 5.- Inspection of imported vehicles

The inspection of imported vehicles complies with the Transport Minister's Decision No. 57/2007/QD-BGTVT of November 21, 2007, promulgating the Regulation on inspection of quality, technical safety and environmental protection in the import of motorcycles and mopeds.

Chapter III

ORGANIZATION OF IMPLEMENTATION

Article 6.- Responsibilities of manufacturing establishments

1. To take responsibility for the origin and quality of products manufactured or assembled by themselves.

2. To strictly observe regulations on inspection of quality, technical safety and environmental protection of manufactured and assembled vehicles.

3. In case of mass production, to manufacture or assemble subsequent products only after obtaining quality and design certificates and ensure that these products are compatible with registration dossiers and tested typical samples.

Article 7.- Responsibilities of importing organizations and individuals

1. To take responsibility for the accuracy and truthfulness of dossiers and documents supplied to the quality-inspecting agency.

2. To produce vehicles in their original conditions to the quality-inspecting agency for inspection.

3. To strictly observe regulations on inspection of quality, technical safety and environmental protection of imported vehicles.

Article 8.- Responsibilities of the Vietnam Register

1. To implement this Regulation; to guide manufacturing establishments and importing organizations and individuals in ensuring requirements on quality, technical safety and environmental protection of manufactured, assembled and imported vehicles;

2. To sum up the results of inspection of vehicle quality for reporting to the Ministry of Transport.
