DECISION No. 23/2000/QD-BTC OF FEBRUARY 21, 2000 PROMULGATING TABLES OF CHARGES AND FEES FOR FOOD QUALITY, HYGIENE AND SAFETY CONTROL

THE MINISTER OF FINANCE

Pursuant to the Government’s Decree No.15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and the ministerial-level agencies;

Pursuant to the Government’s Decree No.178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;

Pursuant to Article 4 of Decree No.86/CP of December 8,1995 "On the assignment of responsibilities for State control of goods quality";

Pursuant to Decision No.14/1999/QD-TTg of February 4, 1999 of the Prime Minister on the establishment of the Department for Food Quality, Hygiene and Safety Control under the Health Ministry;

Pursuant to Directive No.08/1999/CT-TTg of April 15,1999 of the Prime Minister on intensifying the work of ensuring food quality, hygiene and safety;

Pursuant to the Government’s Decree No.04/1999/ND-CP of January 30,1999 on charges and fees belonging to the State budget;

After obtaining opinions of the Health Ministry and at the proposal of the General Director of Tax,

DECIDES:

Article 1.- To promulgate together with this Decision the Table of Charges and Fees for food quality, hygiene and safety control.

The payers of charges and fees at the rates prescribed in this Article are domestic and foreign organizations and individuals engaged in food production, trading and/or import, which are subject to the food quality, hygiene and safety control by competent State bodies of the Health Service.

Article 2.- Agencies collecting the charges and fees for food quality, hygiene and safety control may deduct collected charge and fee amounts before remitting them into the State budget to cover expenses for the work of food quality, hygiene and safety control and the organization of charge and fee collection, according to the approved estimates after obtaining the written consent of the finance bodies of the same level, but the maximum deduction level shall not exceed 90% (ninety percent) of the collected charge and fee amount; the remainder shall be paid into the State budget according to prescribed types, clauses and items of the State budget contents.

The agencies organizing the charge and fee collection shall have to declare, collect, pay and manage charges and fees in strict compliance with Circular No. 54/1999/TT-BTC of May 10, 1999 of the Ministry of Finance, guiding the implementation of the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget.

Article 3.- This Decision takes effect 15 days after its signing; all regulations on charges and fees for food quality, hygiene and safety control contrary to this Decision shall be annulled.

Article 4.- Organizations and individuals subject to payment of charges and fees for food quality, hygiene and safety control, units tasked to organize charge and fee collection and concerned bodies shall have to implement this Decision.
