DECIDES:

Article 1.- To set up the Managing Commission of the Quang Nam-Da Nang Export Processing Zones and Industrial Parks so as to manage the export processing zones and industrial parks in Quang Nam-Da Nang province.

The Managing Commission of the Quang Nam-Da Nang Export Processing Zones and Industrial Parks has the task of managing the export processing zones as provided for in Article 57 of the Regulation on Export Processing Zones issued together with Decree No.322-HDBT of October 18, 1991, and managing industrial parks as provided for in Article 20 of the Regulation on Industrial Parks issued together with Decree No.192-CP on December 28, 1994 by the Government.

The Managing Commission of Quang Nam-Da Nang Export Processing Zones and Industrial Parks has legal person status, its own bank accounts, its own seal with the national emblem, its personnel and budget allocated by the State.

Article 2.- The Managing Commission of Quang Nam-Da Nang Export Processing Zones and Industrial Parks consists of the Head, the Deputy Heads and an assisting apparatus.

The Head of the Managing Commission shall be appointed by the Prime Minister at the proposal of the Minister-Chairman of the Government Commission on Organization and Personnel.

The Deputy Heads shall be nominated by the President of the provincial People's Committee at the proposal of the Head of the Managing Commission and with the agreement from the Minister-Chairman of the Government Commission on Organization and Personnel.

The assisting apparatus of the Managing Commission shall be decided by the Head of the Board with the approval of the Minister-Chairman of the Government Commission on Organization and Personnel.

Article 3.- This Decision takes effect from the date of its signing for promulgation. Decision No.514-TTg of September 17, 1994 of the Prime Minister on the establishment of the Managing Commission of Da Nang Export Processing Zone is now annulled.

Article 4.- The Minister-Chairman of the State Committee for Cooperation and Investment; the Minister-Chairman of the Government Commission on Organization and Personnel; the Minister-Chairman of the State Planning Committee; the Minister of Finance; the Minister of Trade; the Minister of the Interior; the Minister of Construction; the Governor of the State Bank of Vietnam; the General Director of the General Customs Department; the General Director of the General Land Administration; the Heads of the relevant agencies and the President of the People's Committee of Quang Nam-Da Nang province shall have to implement this Decision.
