DECISION No.181-TTg OF MARCH 26, 1997 ON THE ESTABLISHMENT OF THE COUNCIL FOR EVALUATION OF MINERAL RESERVES

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992;

Pursuant to Article 55 of the Law on Minerals of March 20, 1996;

At the proposals of the Minister of Science, Technology and Environment and the Minister-Chairman of the Government Commission on Organization and Personnel,

DECIDES:

Article 1.- To establish the Council for Evaluation of Mineral Reserves on the basis of the Council for Ratification of Mineral Reserves to assist the Prime Minister in evaluating, considering and ratifying mineral reserves (except for minerals used as common construction materials).

The Council has its own seal with the national emblem thereon.

Article 2.- The Council for Evaluation of Mineral Reserves shall have the following tasks and powers:

1. To evaluate, consider and ratify reports on geological surveys to estimate mineral reserves (except for minerals used as common construction materials). To consider and approve reports on State-funded geological surveys to estimate the mineral reserves and evaluate reports on geological surveys funded by other capital sources to estimate the mineral reserves.

To ratify mineral reserves (except for minerals used as common construction materials) estimated in geological reports so as to serve as legal basis for feasibility study, mining design and mine development.

2. To inventory mineral reserves so as to supply related agencies therewith for their planning.

3. To elaborate criteria for the classification of mineral reserves to be promulgated by the Minister of Science, Technology and Environment according to his/her competence.

To issue regulations on reporting on mineral reserve-estimating surveys to serve as basis for the evaluation, consideration and ratification of reports on geological surveys to estimate mineral reserves.

4. To consider, ratify and recognize norms for estimating the mineral reserves.

Article 3.- The Council for Evaluation of Mineral Reserves is composed of:

- The Chairman: the Minister of Science, Technology and Environment

- The Vice-Chairman: A Vice-Minister of Science, Technology and Environment

- The members:

+ A Vice-Minister of Industry,

+ A Vice-Minister of Construction,

+ A Vice-Minister of Agriculture and Rural Development,

+ A Vice-Minister of Planning and Investment,

+ The Director of the Vietnam Geological and Mineral Department.

- A number of cadres with high specialties recommended by the Chairman of the Council for Evaluation of Mineral Reserves to the Prime Minister for consideration and decision.

Members of the Council for Evaluation of Mineral Reserves shall work on a part-time basis.

The Council for Evaluation of Mineral Reserves is entitled to mobilize specialists of different branches to participate in the evaluation and ratification of reports on geological surveys to estimate mineral reserves.

Article 4.- The Council for Evaluation of Mineral Reserves has an assisting office. The office’s working regulations shall be specified by the Chairman of the Council for Evaluation of Mineral Reserves.

The Office of the Council for Evaluation of Mineral Reserves is located at the Ministry of Science, Technology and Environment. Its staff shall be included in the payroll of the Ministry.

Article 5.- This Decision replaces Decision No.08-CP of January 13, 1970 of the Government Council and Decision No.100-HDBT of August 25, 1986 of the Council of Ministers on the organization and operation of the Council for Ratification of Mineral Reserves and shall take effect from the date of its signing for promulgation.

The Chairman of the Council for Evaluation of Mineral Reserves, the Ministers, the Heads of the ministerial-level agencies, the Heads of the agencies attached to the Government, the Presidents of the People’s Committees of the provinces and cities directly under the Central Government shall have to implement this Decision.
