DECISION No.709-TTg OF AUGUST 30, 1997 ON THE ADDITION TO THE 1997 FERTILIZER IMPORT QUOTAS

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992,

At the proposals of the Ministry of Trade (Official Dispatch No.8026-TM/XNK of August 2, 1997), the Ministry of Agriculture and Rural Development (Official Dispatch No.2771-NN-KH/CV of May 5, 1997), and the State Bank of Vietnam (Official Dispatch No.621/CV-NH14 of August 2, 1997) on the import of fertilizer in 1997,

DECIDES:

Article 1.- To add 300,000 tones of urea fertilizer to the 1997 fertilizer import quotas to meet the production requirement of the 1997-1998 winter-spring crop. The list of provinces and enterprises entitled to import the additional fertilizer is attached to this Decision.

With regard to other kinds of fertilizer, the Ministry of Agriculture and Rural Development shall assume the primary responsibility and coordinate with the Ministry of Trade in reviewing the import activities of enterprises which are incapable of fulfilling the assigned quotas for the prompt re-adjustment and re-assignment of such quotas to other enterprises, thereby ensuring the sufficient supply of fertilizer for production.

Article 2.- The principles for the control of fertilizer import shall comply with Decision No.141-TTg of March 8, 1996 of the Prime Minister and attention should be paid to the following issues:

1. For enterprises which are incapable of fulfilling their assigned import quotas, the Ministry of Trade and the Ministry of Agriculture and Rural Development shall promptly report to the Prime Minister for re-adjustment and re-assignment of such quotas to other enterprises.

2. The Ministry of Trade shall direct enterprises assigned to import fertilizer in negotiating and signing purchase contracts directly with the world’s large fertilizer producers according to the mode of deferred payment or goods exchange, thus ensuring a stable market and goods prices.

3. The Ministry of Agriculture and Rural Development shall direct and guide the Northern Food Corporation, the Southern Food Corporation, the Agricultural Supplies Corporation and the Cereal Import-Export Corporation in the establishment of a network of fertilizer sale and rice-purchase agents in provinces in order to promptly complete the elaboration of the project on the re-arrangement of fertilizer and food trading branches in the whole country.

4. The State Bank of Vietnam shall directly and promptly instruct the commercial banks in providing loans and guaranty for enterprises assigned to import fertilizer in accordance with the Prime Minister’s directions in Official Dispatch No.3543/KTN of July 17, 1997, regarding the purchase of rice for temporary reserve and import of fertilizers so that enterprises may take their initiative in fulfilling their assigned quotas, thus ensuring the prompt and sufficient supply of fertilizer for production in the 1997-1998 winter-spring crop.

Article 3.- The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of the provinces and cities directly under the Central Government shall have to implement this Decision.
