RESOLUTION No. 23/2003/QH11 OF NOVEMBER 26, 2003 ON HOUSES AND LAND MANAGED OR ARRANGED BY THE STATE FOR USE IN THE COURSE OF IMPLEMENTATION OF HOUSE AND LAND MANAGEMENT POLICIES AND SOCIALIST TRANSFORMATION POLICIES BEFORE JULY 1, 1991

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Deeming that in the cause of struggle for national liberation, conducting the people's national democratic revolution and the socialist revolution, the State has promulgated and organized the implementation of policies on house and land management and policies on socialist transformation related to houses and land. These policies stemmed from the conditions and specific circumstances of the revolution in each period, and were of historic character, contributing to the successful implementation of the cause of construction and defense of the socialist Vietnamese Fatherland.

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001 of the Xth National Assembly, the 10th session;

Pursuant to the Government's Report No. 1516/CP-CN of November 5, 2003, the Law Committee's on verification report and opinions of National Assembly deputies,

RESOLVES:

Article 1.- The State shall not reconsider the policies and the implementation of the policies on house and land management and the policies on socialist transformation related to houses and land, which had been promulgated before July 1, 1991.

The State shall not recognize the reclaim of houses and/or land, which have been managed and arranged by the State for use in the process of implementation of policies on house and land management and the policies on socialist transformation related to houses and land.

Article 2.- The State has completed the legal procedures for the entire-people's ownership over types of houses and land, which have been managed and arranged by the State for use in the process of implementation of the policies on:

1. The transformation of houses and land for lease;

2. The transformation of private capitalist commerce and industry directly related to houses and land;

3. The management of houses and land of organizations, individuals (in category 2/IV) in southern provinces and cities after the liberation day (April 30, 1975);

4. The management of houses and land with their owners being absent;

5. The management of houses and land at every given time as well as houses and land of associations, religious organizations;

6. The management of houses and land of persons who have taken refuge in other countries, moved to other regions or left for foreign countries.

Article 3.- For cases where owners of houses and land managed and arranged by the State for use in the process of implementation of policies on house and land management and the policies on socialist transformation related to houses and land now actually meet with housing difficulties, the State shall work out policies to create conditions for them to improve their residences.

Article 4.- To assign the National Assembly Standing Committee, basing itself on this Resolution of the National Assembly and the proposal of the Government, to prescribe the solutions to a number of specific cases, ensuring the State's interests, the citizens' legitimate rights and interests and the suitability to the practical conditions of the country.

Article 5.- This Resolution takes implementation effect as from July 1, 2004.

The Government shall guide, direct and organize the uniform implementation of this Resolution nationwide, ensuring to complete the implementation thereof within five years as from the date this Resolution takes implementation effect in the spirit of expedition and thrift.

Vietnam Fatherland Front and its member organi-zations shall propagate and disseminate the National Assembly's Resolution widely among people of all strata and mobilize them to strictly implement it.

The National Assembly calls upon the compatriots in the country and overseas Vietnamese, for the entire nation's interests, to support and strictly implement the National Assembly's Resolution, considering this a practical contribution to the cause of national stability and development.

This Resolution was adopted on November 26, 2003 by the XIth National Assembly of the Socialist Republic of Vietnam, at its 4th session.
