DECISION No. 124/2002/QD-TTg OF SEPTEMBER 20, 2002 ON ELECTRICITY SELLING PRICES

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of December 25, 2001;

At the proposals of the head of the Government’s Pricing Committee (in Report No.702/BVGCP-TLSX of September 6, 2001, Official Dispatch No.255/BVGCP-TLSX of April 16, 2002, Official Dispatch No.297/BVGCP-TLSX of April 29, 2002, and Official Dispatch No.622/BVGCP-TLSX of August 2, 2002) and proceeding from the opinions of the concerned ministries and branches,

DECIDES:

Article 1.-

1. To promulgate the selling prices of electricity in service of production, business, daily life consumption and operation of administrative and non-business agencies, which are applicable to electricity purchase/sale contracts signed directly with the electricity industry as prescribed in the Appendix enclosed herewith.

2. Electricity selling prices prescribed in the Appendix have not yet included value added tax.

Article 2.- The Ministry of Industry shall coordinate with the Government’s Pricing Committee in taking measures to direct the strict application of the ceiling price of rural daily-life electricity according to provisions in the Prime Minister’s Official Dispatch No.1303/CP-KTKH of November 3, 1998.

Article 3.- The presidents of the People’s Committees of the provinces and centrally-run cities shall direct the enhancement of the management over units and organizations selling electricity to peasants’ households, thus ensuring the strict observance of the said ceiling price level.

Article 4.- To abolish the regime of electricity surcharge collection throughout the country.

Article 5.- The amounts collected due to the electricity price increase shall be invested in the electricity service’s development in forms of crediting State budget remittances, and debiting investment capital allocations to Vietnam Electricity Corporation. The Finance Ministry is assigned to assume the prime responsibility for and coordinate with the concerned agencies in guiding the implementation thereof.

Article 6.- The electricity industry must intensify measures to raise labor productivity and service quality, and reduce electricity loss and electricity production costs, so as to increase capital for its development investment.

Article 7.- Enterprises must devise measures to rationally use electricity, especially in high-demand hours, and economize to the utmost the electricity use, thus reducing electricity expense in their cost prices. The important manufacturing industries, which have applied all measures to minimize impacts of the electricity price increase but still have their products’ cost prices greatly affected, shall report such to the competent State agencies, so that the latter can propose the Prime Minister to consider and decide.

Article 8.-

1. The Ministry of Industry shall coordinate with the Government’s Pricing Committee and Vietnam Electricity Corporation in guiding the implementation of this Decision.

2. This Decision takes effect as from October 1, 2002. The previous decisions issued by the Prime Minister, which are contrary to this Decision, shall all be hereby annulled.

Article 9.- The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of the provinces and centrally-run cities shall have to implement this Decision.
