THE MINISTRY OF FINANCE DECISION No. 20/2000/QD-BTC OF FEBRUARY 21, 2000 ISSUING THE TABLE OF CHARGE AND FEE RATES FOR THE AQUATIC RESOURCE PROTECTION THE MINISTER OF FINANCE Pursuant to the Government’s Decree No. 15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies; Pursuant to the Government’s Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance; Pursuant to Clause 3, Article 5 of Decree No. 93/CP and Articles 18, 19 and 20 of the Regulation on the implementation of the Ordinance on Veterinary Drugs issued together with Decree No. 93/CP of November 27, 1993 of the Government; Pursuant to Clauses 6 and 7, Article 2 of the Government’s Decree No. 50/CP of June 21, 1994 on the tasks, powers and organizational structure of the Ministry of Aquatic Resources; Pursuant to the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget; After obtaining the opinion of the Ministry of Aquatic Resources and at the proposal of the General Director of Tax, DECIDES: Article 1.- To issue together with this Decision the Table of charge and fee rates for the aquatic resource protection. 1. Payers of charges and fees at the rates prescribed in this Article are foreign and Vietnamese organizations and individuals conducting production and business activities in the field of aquatic resources after they are granted operation licenses and their fishing means and gear have gone through safety inspection and their aquatic products have gone through quality and veterinary inspection by the aquatic resource protection agencies as prescribed by law. 2. In cases where a license is re-granted or extended, only 50% of the prescribed corresponding charge or fee rate shall be collected. In cases where verification is required or the procedures for granting a new license must be completed, a fee shall be collected as in cases of granting of new licenses. 3. In cases where a customer makes a written request for an inspection outside the working hours prescribed by the State so as to meet time requirements, a surcharge equal to 50% (fifty per cent) of the rate prescribed in the appendices attached to this Decision shall be collected. 4. Charges and fees shall be collected in Vietnam dong. Where the charge or fee rate is set in US dollar (USD), it shall be converted into Vietnamese currency at the exchange rate announced by the State Bank of Vietnam at the time of collection. Article 2.- The Department for Aquatic Resource Protection under the Ministry of Aquatic Resources, the local sub-departments for aquatic resource protection and aquatic resource centers (collectively referred to as aquatic resource protection agencies that organize the collection of charges and fees for aquatic resource protection shall be allowed to deduct 40% (forty per cent) of the total amount of collected charges and fees before remitting them into the State budget in order to cover the expenses for organization of charge and fee collection; the remainder (60%) must be remitted into the State budget. The Department for Aquatic Resource Protection of the Ministry of Aquatic Resources shall have to direct and guide the aquatic resource protection agencies to collect, remit and manage the use of charges and fees for aquatic resource protection in an uniform manner nationwide according to the Finance Ministry’s Circular No. 54/1999/TT-BTC of May 10, 19999 guiding the implementation of the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget. Article 3.- This Decision takes effect 15 days after its signing. All regulations on the collection, payment and management of charges and fees for aquatic resource protection, which are contrary to this Decision, are now annulled. Article 4.- Organizations and individuals that have to pay charges and fees for aquatic resource protection, the Department of Aquatic Resource Protection, charge-and fee-collecting agencies and related agencies shall have to implement this Decision.- For the Minister of Finance
