DECREE

Defining the functions, tasks, powers and organizational structure of Vietnam television Station

THE GOVERNMENT

Pursuant to the December 25, 2001 Law on Organization of the Government;

At the proposal of the General Director of Vietnam Television Station and the Minister of Home Affairs,

DECREES:

Article 1.- Position and functions

1. Vietnam Television Station is a government-attached national television station and functions to provide information on and propagate the Party's guidelines and policies and the State's laws, and provide public services; contributes to educating and raising people's intellectual standards and serves their spiritual life through television programs.

2. Vietnam Television Station is abbreviated in Vietnamese to THVN; its international transaction name is Vietnam Television, abbreviated to VTV.

3. Vietnam Television Station is subject to the Ministry of Information and Communication's state management of press activities and broadcasting frequencies.

Article 2.- Tasks and powers

Vietnam Television Station has the following tasks and powers:

1. To propose the Government to prescribe, change or supplement its functions, tasks and organizational structure; to propose the Prime Minister to decide on the establishment, merger, dissolution or change of names of its units under the Prime Minister's competence.

2. To submit to the Government or the Prime Minister its strategies, master plans, long-term, five-year and annual plans, and other key projects under the deciding competence of the Government or the Prime Minister; to implement strategies, master plans and plans after they are approved.

3. To elaborate plans on, formulate, and submit to the Ministry of Science and Technology for appraisal and promulgation, national standards under Clause 1, Article 17 of the Law on Standards and Technical Regulations; to formulate and announce manufacturer standards under Article 20 of the Law on Standards and Technical Regulations; to elaborate plans on, formulate, and submit to the Minister of Science and Technology for appraisal and promulgation, national technical regulations under Clause 4, Article 9 of the Government's Decree No. 127/2007/ND-CP of August 1, 2007, detailing the implementation of a number of articles of the Law on Standards and Technical Regulations.

4. To participate in drawing up strategies and master plans on the development of Vietnam's television system.

5. To assume the prime responsibility for, and coordinate with local television stations and radio-television stations in, working out plans on the production of national television programs.

6. To decide on and be responsible for its daily broadcasting contents, programs and time volume.

7. To directly manage its special-use technical system for the production of programs, transmission of signals and broadcasting of national television programs at home and abroad.

8. To manage investment and construction projects under its competence according to law; to participate in appraising important schemes and projects related to its professional operations as assigned by the Prime Minister.

9. To take the prime responsibility for, and coordinate with concerned agencies in, working out a financial mechanism for Vietnam Television Station suitable to its functions, tasks and powers and in accordance with the law on state budget and other relevant laws, to request the Minister of Finance to promulgate this mechanism.

10. To comply with financial, labor and wage mechanisms applicable to state enterprises.

11. To operate on the principle of autonomy and accountability for its task performance, organizational apparatus, payroll and finance according to law.

12. To decide on the use of state funds managed by Vietnam Television Station for investment in and establishment of enterprises after getting the Prime Minister's approval.

13. Vietnam Television Station is the owner of enterprises which are established under its decisions and the owner of shares contributed to its attached enterprises according to law.

14. To decide on, and direct the implementation of, its administrative reform program according to the objectives and contents of the State's administrative reform program approved by the Prime Minister.

15. To provide local television and radio-television stations with guidance on Vietnamese and English acronym names and English names of local television and radio-television stations, and on television operations and techniques.

16. To provide training and retraining in television operations according to law.

17. To conduct scientific research into and apply television technological and scientific advances.

18. To cooperate with regional and world television stations according to law.

19. To manage its organizational apparatus and payroll; direct the implementation of the wage regime, and mechanisms and policies on preferential treatment, commendation and discipline for cadres, civil servants and laborers under its management according to current law;

20. To settle complaints and denunciations according to its competence; to prevent and combat corruption, waste, bureaucracy, imperiousness and harassment at its attached units.

21. To implement the mechanism on reporting to the Government, the Prime Minister and competent Party and State agencies and perform other tasks and exercise other powers according to law.

Article 3.- Organizational structure

1. The Editorial Secretariat.

2. The Organization and Personnel Department.

3. The Planning-Finance Department.

4. The International Cooperation Department.

5. The Examination Board.

6. The Office.

7. The Current Affairs Department.

8. The Science and Education Department.

9. The Department for Broadcast in Ethnic Minority Languages.

10. The Foreign Service Department.

11. The Literature and Arts Department.

12. The Sports-Entertainment and Economic Information Department.

13. The Cable Television Editorial Department.

14. The Adolescents and Children Department.

15. The Center for Documentaries and Television Reports.

16. The Center for Television Film Production.

17. The Archive Center.

18. Vietnam Television Station Center in Ho Chi Minh City.

19. Vietnam Television Station Center in Hue city.

20. Vietnam Television Station Center in Da Nang city.

21. Vietnam Television Station Center in Phu Yen province.

22. Vietnam Television Station Center in Can Tho city.

23. The Technical Center for Program Production.

24. The Technical Center for Transmission and Broadcasting.

25. Vietnam Television Station's foreign-based offices established under decisions of the Vietnam Television Station General Director after getting the Prime Minister's approval.

26. The Center for Research and Application of Television Science and Technology.

27. The Television Operations Training Center.

28. The Center for Television Advertisement and Services.

29. The Center for Information Technology and Metrology.

30. The Television Magazine.

The units from Clause 1 thru Clause 6 of this Article are units assisting the General Director. The units from Clause 7 thru Clause 25 are program production and broadcasting units. The units from Clause 26 thru Clause 30 are other non-business units.

The General Director of Vietnam Television Station may dissolve, establish and arrange the organization of, the remaining units under his/her competence according to law.

Vietnam Television Station's Departments and equivalent units each have a director (or equivalent) and not more than three deputy directors to assist the director.

Departments and equivalent units have sections and working groups.

Article 4.- Leadership

1. Vietnam Television Station has its General Director and not more than four deputy general directors.

2. The General Director and deputy general directors are appointed and dismissed by the Prime Minister according to law.

3. The General Director shall take responsibility before law, the Government and the Prime Minister for the entire operation of Vietnam Television Station; deputy general directors shall assist the General Director and take responsibility before law and the General Director for their assigned duties.

4. The General Director shall define the functions, tasks, powers and organizational structures of Vietnam Television Station-attached units.

5. The General Director may appoint, dismiss or relieve from office heads and deputy heads of Vietnam Television Station-attached units.

Article 5.- Implementation effect and responsibilities

1. This Decree takes effect 15 days after its publication in "CONG BAO" and replaces the Government's Decree No. 96/2003/ND-CP of August 20, 2003, defining the functions, tasks, powers and organizational structure of Vietnam Television Station.

2. To annul all previous provisions contrary to this Decree.

3. The General Director of Vietnam Television Station, ministers, heads of ministerial-level agencies, heads of government-attached agencies, and presidents of provincial/municipal People's Committees shall implement this Decree.
