DECISION No. 82/2003/QD-TTg OF APRIL 29, 2003 APPROVING THE MASTER PLANNING ON CONSERVATION, REPLENISHMENT AND PROMOTION OF THE VALUE OF HOA LU ANCIENT CAPITAL HISTORICAL-CULTURAL RELIC, NINH BINH PROVINCE

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the June 29, 2001 Law on Cultural Heritages;

At the proposal of the People’s Committee of Ninh Binh province (in Official Dispatch No. 38/TTr-UB of August 6, 2002) and the opinions of the Ministry of Planning and Investment (in Official Dispatch No. 67/BKH/VPTD of January 3, 2003),

DECIDES:

Article 1.- To approve the master planning on conservation, replenishment and promotion of the value of Hoa Lu ancient capital historical-cultural relic, Ninh Binh province, with the following principal contents:

1. Objectives:

a/ To determine legal bases in the management, conservation and promotion of the value of Hoa Lu ancient capital historical-cultural relics complex according to the Law on Cultural Heritages.

b/ To protect, detect, clarify and enrich the tangible and intangible cultural values of the relic, create a premise for proposing the recognition of Hoa Lu ancient capital as a world cultural heritage.

c/ To serve as ground for elaborating detailed plannings, projects and programs on conservation, replenishment as well as reasonable and efficient promotion of the relic’s value, serving as basis for elaborating, evaluating and approving projects as well as making implementation plans, calling for investment and mobilizing capital sources.

d/ To coordinate it with the master planning on the province’s socio-economic development as well as specialized plannings and urban plannings in the province, ensuring the sustainable development of the region.

2. Planning and zoning scope covers the tangible and intangible cultural values of Hoa Lu ancient capital relic and other relics directly related to the relic zone, which are zoned off as follows:

a/ Special-protection zone with an area of 300 ha, including:

- The entire inner and outer region;

- The historic relics of Dinh and Le Kings temples and mausoleums, Phat Kim Princess temple, Nhat Tru pagoda, Cau Den stela, Ngan pagoda, Bim cave, underground sections of citadel and palace grounds, Ma Yen mountain, Phi Van mountain, Cot Co mountain, Sao Khe river, and Trang An caves.

b/ Buffer zone with an area of 1,087 ha, including Am Tien cave, Quan cave, Muoi cave, Luon cave, Lien Hoa cave, Ban Long pagoda, the entire landscapes along Sao Khe river, and population quarters of Yen Ha and Vang Ngoc villages; and relics directly related thereto, which have been already ranked.

3. Objects:

The planning’s principal objects to be conserved is Hoa Lu ancient capital historical-cultural relic include rock mountains, caves, rivers, forests, temples, pagodas, ancient architectural works, mountainous and aquatic fauna, folk culture, folklore, traditional rites, and traditional handicrafts.

4. Implementation solutions:

a/ To elaborate specific feasible projects according to the priority order under the current regulations on investment and construction management.

b/ To elaborate the Regulation on management of activities in Hoa Lu ancient capital relic.

5. Implementation duration: Between 10 and 15 years, starting from 2003.

6. Capital sources:

a/ Capital allocated from the central budget under annual plans;

b/ Capital from the local budget;

c/ Capital mobilized from the society’s contributions and investments;

d/ Other lawful capital sources.

Article 2.- The People’s Committee of Ninh Binh province shall have to assume the prime responsibility and coordinate with the Ministry of Culture and Information and relevant agencies in performing the following tasks:

a/ To continue conducting the archaeological research, documentation and excavation in order to determine and supplement scientific grounds for further clarifying the ranking of relics, marking off zones for relics protection, correctly valuing the relics and other works related to the relic zone. In the immediate future, it is necessary to take measures to preclude and handle in time acts of infringing upon the ranked relics and natural landscapes belonging to the conservation zones.

b/ On the basis of the approved master planning, to study and elaborate detailed plannings on conservation zones, which clearly demonstrate the relationships between the activities of relics conservation, replenishment and sustainable socio-economic development in order to protect and promote the value of the relics, and at the same time ensure the production stability, unceasingly improve the people’s life. In the immediate future, priority shall be given to special-protection zone, buffer zone and relics directly related to the ranked Hoa Lu ancient capital.

c/ Based on the detailed planning of each above-said zone, to elaborate, evaluate and approve component projects according to the current regulations. For each component project, attention should be paid to selecting the investors and reasonably determining capital sources. The State budget shall invest mainly in special-protection zone, buffer zone and relics directly related to Hoa Lu ancient capital; take measures to mobilize the people’s physical and material contributions to the preservation, protection and investment in conservation, replenishment and promotion of the relics’ value.

d/ To study and promulgate the Statute and Regulation on management of investment and construction activities as well as economic-cultural-social activities in the whole relic zone and each specific zone.

Article 3.- Responsibilities of the concerned ministries and branches:

a/ The Ministry of Culture and Information shall have to monitor and supervise the implementation of the planning according to the set objectives; take responsibility for the specialized evaluation of component projects and items on conservation, replenishment and promotion of historical-cultural relics.

b/ The Ministry of Agriculture and Rural Development, the Ministry of Communications and Transport, and Vietnam National Administration of Tourism shall have to monitor and supervise the implementation of the planning, ensuring the compliance with the branch’s planning in the locality within the relics zone’s scope.

c/ The Ministry of Construction shall have to evaluate the planning on construction of Ninh Binh provincial capital, Thien Ton township and Me township to ensure that the construction shall neither spoil the relic zone’s views nor infringe upon the relics-protection areas, especially in special-protection zone.

d/ The Ministry of Natural Resources and Environment shall have to monitor, supervise and take prompt measures to preclude the violation of the Law on Environmental Protection and sub-law legal documents regarding the relics zone in the course of implementation of the planning and execution of component projects.

Article 4.- The president of the People’s Committee of Ninh Binh province, the ministers, the heads of the concerned ministerial-level agencies or agencies attached to the Government shall have to implement this Decision.

This Decision takes effect 15 days after its publication in the Official Gazette.
