Re: Amendment to the Announcement of the Council for Democratic Reform No. 15 dated 21st September B.E. 2549 (2006)


Pursuant to the Announcement of the Council for Democratic Reform No. 15 dated 21st September B.E. 2549 (2006) which continues the enforcement of the Organic Act on Political Party, B.E. 2541 (1998), in order to clarify the enforcement of such law and also to prescribe the provisions on suspension of the right to vote at an election of persons involving an illegal commission of under such law, the Council for Democratic Reform hereby announces as follows:

Clause 1. The provisions of clause 1 of the Announcement of the Council for Democratic Reform No. 15 dated 21st September B.E. 2549 (2006) shall be repealed and replaced by the following:
“Clause 1. The repeal of the Constitution of the Kingdom of Thailand shall not affect to the Organic Act on Political Party, B.E. 2541 (1998), and the Organic Act on Political Party, B.E. 2541 (1998) shall remain in force until it is amended or repealed by law.”

Clause 2. The prohibition of political parties from organizing meetings or carrying out any political activity as prescribed in the Announcement of the Council for Democratic Reform No. 15 dated 21st September B.E. 2549 (2006) shall remain in force until the Council of Ministers passes a resolution otherwise.

Clause 3. In the case where the Constitutional Court or another organization acting as the Constitutional Court dissolves any political party on the ground that it has violated a prohibition under the Organic Act on Political Party, B.E. 2541 (1998), the right to vote at an election of members of the Executive Board of such political party shall be suspended for a period of five years as from the date of dissolution order.

Clause 4. The right to vote at an election of any person whose right to vote at an election has been suspended by a Court order under the Organic Act on an Election of Members of the House of Representatives and Senators, B.E. 2541 (1998) prior to the entry into force of the Announcement of the Council for Democratic Reform No. 3, dated 19th September B.E. 2549 (2006) shall remain suspended under such Court order.
