Re: Selected Organic Law still in Force


For the continuation of the prevention and suppression of corruption, it is necessary to revise the Organic Law on National Counter Corruption Commission, B.E. 2542 (1999) and the revised Act shall continue in force. The Council for Democratic Reform therefore hereby announces as follows:

Clause 1. The Organic Law on National Counter Corruption Commission, B.E. 2542 (1999) shall continue to be in force, provided that the provisions on selection shall be suspended.

Clause 2. The Organic Law on Criminal Procedure for a Person Holding Political Position, B.E. 2542 (1999) shall continue to be in force.

Clause 3. There shall be the National Counter Corruption Commission under the Organic Law on National Counter Corruption Commission, B.E. 2542 (1999) consisting of:

(1) Mr. Panthep Klanarongran President
(2) Mr. Klanarong Chanthick member
(3) Mr. Jaided Pornchaiya member
(4) Mr. Prasatpong Sivaphai member
(5) Professor Pakdee Pothisiri member
(6) Professor Maethee Krongkeaw member
(7) Mr. Vicha Mahakhun member
(8) Mr. Vichai Vivichsevi member
(9) Miss Somluck Chadkrabuanpol member

Clause 4. In the case where the President or a member under clause 3 becomes vacant for any reason whatsoever and the remainder are at least not less than six members, the Commission shall compose of the remaining members.
If the President vacates office, the remaining members shall select one among themselves to be the President.
In the case where the members vacate office and the remaining members are less than six in number, the Prime Minister shall select and propose the qualified persons to the Assembly exercising legislative power for approval and then report to the King for further appointment or proceed selection and appointment procedure under the law enforced at that time, as the case may be.

Clause 5. The President or members under clause 3 shall proceed the procedure under section 11 of the Organic Law on National Counter Corruption Commission, B.E. 2542 (1999) within fifteen days as from the date this Announcement comes into force.
In the case where the person under clause 3 fails to comply with the period as prescribed in paragraph one or unable to take office, the provisions of
clause 4 shall apply mutatis mutandis.
