Act on Establishment of Government Organisations 1953

ACT ON ESTABLISHMENT OF GOVERNMENT ORGANISATIONS, B.E. 2496 (1953)

BHUMIBOL ADULYADEJ, REX.

Given on the 6th Day of February B.E., 2496;

Being the 8th Year of the Present Reign.

His Majesty King Bhumibol Adulyadej is graciously pleased to proclaim that:

Whereas it is expedient to have the law on establishment of Government Organisations;

Be it, therefore, enacted by and with advice and consent of the Assembly of the People's Representatives, as follows:

Section 1. This Act is called the "Act on Establishment of Government Organisations, B.E. 2496".

Section 2. This Act shall come into force as from the day following the date of its publication in the Government Gazette.*

Section 3. Whenever the Government deems it expedient to establish an organisation to carry out activities which are of public interest, or for the economic interest, or to facilitate means of living or to render services to the public, by allocating funds from the budgetary appropriations, it shall be done by an enactment of a Royal Decree .

Section 4. The Government organisation which is established under this Act shall be a juristic person.

Section 5. The Royal Decree establishing the organisation under section 3 shall at least include the following particulars:

(1) name of the organisation;

(2) location of the head office;

(3) objects of the organisation;

(4) authorised capital;

(5) distribution of the benefit;

(6) control and administration of the activities of the organisation including the power and duties of the Board, Director or Manager, as the case may be;

(7) accounts and audits;

(8) other prescriptions as may be necessary for the proper undertaking of the activities of the organisation.

Section 6. The abolition of the organisation established under this Act shall be made by a Royal Decree which shall specify the procedure for the settlement of its properties.

Section 7. The Prime Minister shall have charge and control of the execution of this Act.
