Publicação do Acordo sobre a Dispensa de Vistos entre o Governo da Região Administrativa Especial de Macau da República Popular da China e o Governo da República de Namíbia

O Chefe do Executivo manda publicar, nos termos do n.º 1 do artigo 6.º e da alínea 2) do artigo 5.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, o Acordo sobre a Dispensa de Vistos entre o Governo da Região Administrativa Especial de Macau da República Popular da China e o Governo da República de Namíbia.

Promulgado em 26 de Setembro de 2001.

Agreement between the Government of the Macao Special Administrative Region of the People's Republic of China and the Government of the Republic of Namibia on Mutual Exemption of Visa Requirements

PREAMBLE

The Government of the Macao Special Administrative Region of the People's Republic of China and the Government of the Republic of Namibia (hereinafter referred to as the two Contracting Parties and in the singular as a ''Contracting Party''),

DESIROUS of developing friendly relations and facilitating personnel exchanges between the two Contracting Parties,

PROMOTING trade and economic development and facilitating movement of citizens between Macao and Namibia;

And after having friendly consultations;

HAVE AGREED AS FOLLOWS:

Article 1

1.1 Citizens of the People's Republic of China, who are holders of valid passports or travel permits of the Macao Special Administrative Region of the People's Republic of China and hold return or onward tickets, shall be exempted from visa requirements for entry into, exit from or transit through the territory of the Republic of Namibia. The duration of stay in the territory of the Republic of Namibia during each visit shall not exceed thirty (30) days.

1.2 Citizens of the Republic of Namibia, who are holders of valid passports of the Republic of Namibia (including the accompanying persons who share the same passports of the holder) and hold return or onward tickets, shall be exempted from visa requirements for entry into, exit from or transit through the territory of the Macao Special Administrative Region of the People's Republic of China. The duration of stay in the territory of Macao during each visit shall not exceed thirty (30) days.

1.3 The accumulative duration of stay of the citizens in territories of the Contracting Parties during one calendar year should not exceed ninety (90) days.

Article 2

2.1 The passport or travel permit holders referred to in Article 1 shall abide by the relevant laws and regulations of the other Contracting Party during their stay in its territory.

2. Where their stay in that territory would exceed the valid period of visa exemption the passport holders of travel permit referred to in Article 1 shall go through the relevant procedures and obtain the necessary authorization in accordance with the laws and regulations enforced by the competent authorities of the other Contracting Party for stay in its territory.

Article 3

In order to facilitate the training of nationals of the Contracting Parties the receiving Contracting Parties shall issue the necessary permit to bona fide students and trainees for the duration of stay exceeding thirty (30) days in accordance with the relevant local laws, regulations and procedures.

Article 4

This Agreement does not restrict the right of the Government of the Macao Special Administrative Region of the People's Republic of China and the Government of the Republic of Namibia to prohibit personae non grata or unacceptable persons of the other Contracting Party from entering its territory or to terminate their stay in its territory without citing reasons therefor.

Article 5

Either Contracting Party may temporarily suspend the implementation of this Agreement partly or wholly on grounds of national security, social order and public health. However, the other Contracting Party shall be notified in advance of such suspension of the Agreement and its subsequent release through diplomatic channels. The suspension and release shall enter into force on the date of receipt of that notice by the other Contracting Party.

Article 6

6.1 The two contracting Parties shall complete the exchange of samples of their passports and travel permits referred to in Article 1 within thirty (30) days of the signing of this Agreement through diplomatic channels.

6.2 Either Contracting Party, in case of any change of the forms of the said passports or travel permits, shall inform the other Contracting Party, thirty (30) days in advance and furnish it with samples of new passports or travel permits.

Article 7

7.1 This Agreement shall provisionally enter into force on the date of signature and shall definitely come into force upon its ratification in accordance with the legal requirements of the Contracting Parties, where appropriate.

7.2 This Agreement shall remain valid for an automatically renewable period of five (5) years. If either Contracting Party wishes to terminate this Agreement, it shall notify the other Contracting Party in writing through diplomatic channels. This Agreement shall cease to be effective on the ninetieth (90) day after the date of that notice.

7.3 Additional clauses or amendments to this Agreement may be made, as appropriate, by the two Contracting Parties after consultations.

THUS DONE and SIGNED at WINDHOEK on this 27th of JULY TWO THOUSAND AND ONE (2001) in duplicate in the Chinese and English Languages, both texts being equally authentic.
