An Ordinance to validate the selection of Naib-Tehsildars and Naib-Tehsildar candidates

Preamble.— WHEREAS it is expedient to validate the selection of Naib-Tehsildars and Naib-Tehsildar candidates made during the years 1960 and 1961;

      Now, THEREFORE, in pursuance of the Presidential Proclamation of the seventh day of October, 1958, and in exercise of all powers enabling him in that behalf, the Governor of West Pakistan is pleased to make and promulgate the following Ordinance:-

1.   Short title.— This Ordinance may be called the West Pakistan Validation of Naib-Tehsildars and Naib-Tehsildar Candidates Selection Ordinance, 1962.

2.   Definitions.— In this Ordinance, unless the context otherwise requires, the following expressions shall have the meanings hereby respectively assigned to them, that is to say—

      (a)  “existing rules” means—

               (i)  The Punjab Tehsildari Service Rules, 1953;

              (ii)  The Bahawalpur State Tehsildari Service Rules, 1941;

             (iii)  The rules for the selection of Naib-Tehsildar candidates in the Quetta Division published with the late Agent to the Governor-General and Chief Commissioner in Baluchistan’s order No.E-101/51, dated the 25th December, 1951; and

             (iv)  The Kalat State Services Punishment and Appeal Rules, 1945;

      (b)  “Government” means the Government of West Pakistan.

3.   Validation of selection of Naib-Tehsildars and Naib-Tehsildar candidates.— (1) Notwithstanding anything contained in the existing rules governing the selection or appointment of Naib-Tehsildars and Naib-Tehsildar candidates, or in any decree, order or judgment of a Court, the persons specified in column 3 of Part A of the Schedule shall be deemed to have been validly selected as Naib-Tehsildars, and the persons specified in [2][column 3] of Part B of the Schedule shall be deemed to have been validly selected as Naib-Tehsildar candidates from the dates specified against their names in column 4 of the Schedule.

      (2)  Government may, within a period of one month from the coming into force of this Ordinance, add to the names specified in the Schedule.

4.   Terms and conditions of service.— The terms and conditions of service of the Naib-Tehsildars and Naib-Tehsildar candidates whose selection is validated under the provisions of section 3 shall be such as may be specified by Government.
