Recommended Disciplinary Measures against Violation of Privacy due to Leakage of Criminal Record of Private Individual

A petition that the respondent violated the right to privacy of the
complainant by leaking the criminal record of the complainant to his roommate
in an actual marriage relation was filed with the Commission. The results of
examination by the Commission concluded that the acquisition by the police of
the criminal record of the complainant and their wrongfully leaking of the
information to the third party was in violation of Article 6 of Punishment Act
and a violation of the right to privacy of the complainant guaranteed by Article
17 of the Constitution. On this ground, the Commission recommended that
disciplinary measures be taken against the policeman in question.
