RULES ON THE GENERAL EDUCATION DEVELOPMENT TEST FOR QUALIFICATIONS TO ENTER HIGH SCHOOL

Rules on the General Education Development Test for Qualifications to Enter High School

Article 1 (Purpose) The purpose of these rules is to prescribe matters necessary for the General Educational Development for Qualifications to Enter High School, (hereinafter referred to as "GED Test"), pursuant to Article 97, Paragraph (2) of the Enforcement Decrees of the Elementary and Secondary Education Act. Article 2 (GED Test Committee)

(1) The GED shall be conducted by the GED Test Committee, (hereinafter referred to as the "Committee"), under the control of the superintendent of the office of education located in the Special Metropolitan City, Metropolitan City, and Do, (hereinafter referred to as the "City and Do"), pursuant to Article 2 of the Rules on the General Educational Development Test for High School Diplomas.

(2) The Committee may jointly conduct the GED Test with committees under the control of other superintendents of the office of education. (3) With respect to the function of the committee, the appointment of members preparing the test and members marking the test, and the operation of the committee, the provisions of Articles 3 and 4, Paragraph (4), Subparagraphs 6 and 7-2 of the Rules on the General Educational Development Test for High School Diplomas shall apply mutatis mutandis.

Article 3 (Publication of the GED Test)

(1) The GED Test shall be conducted more than twice per year.

(2) The Committee shall publish the date, time, and place of the test, the period and place for accepting test applications, and other matters necessary for conducting the test two months prior to the test. [Whole provision amended on Dec. 14, 1977]

Article 4 (Method of the GED Test) The GED Test shall be a multiple-choice written test, with knowledge and application proficiency equivalent to graduates of middle school. Article 5 (Subjects of the GED Test)

The subjects of the GED Test are as shown in the <%:0%>. [Whole provision amended on Dec. 14, 1977]

Article 5-2 (Qualifications)

(1) A person who can apply for the test shall be a person who falls under any of the following subparagraphs. However, a person who graduates from middle school or the schools specified in Article 97, Paragraph (1), Subparagraph 2 of the Enforcement Decree of Elementary and Secondary Education Act, or a person who attends such schools shall be excluded:

1. Elementary school graduates and persons with equivalent scholastic ability;

2. Graduates or graduates-to-be of a 3-year high civil education center;

3. Graduates or graduates-to-be of diverse schools equivalent to middle schools;

4. Persons specified in Article 69, Paragraph (2) of the Enforcement Decree of the Juvenile Reformatory Act.

(1) Notwithstanding the provisory clauses of Paragraph (1), a person whose school register is managed as supernumerary as specified in Article 29 of the Enforcement Decree of the Elementary and Secondary Education Act may apply for the test.

(3) The graduates-to-be specified in Paragraph (1) means a person in the highest grade of school.

Article 6 (Submission of the Application) A person who intends to apply for the test shall submit the application for the General Educational Development Test for Qualifications to Enter High School in the Appendix No. 1 form to the chairperson of the committee with the following documents attached:

1. One copy of the certificate of the highest educational background, such as a certificate of graduation, certificate of expected graduation, certificate of enrolment previously, or a copy of the certificate of the General Educational Development Test for Qualifications to Enter Middle School;

2. One photo showing the upper body without a cap and taken within three months prior to the application; and

3. A certificate of passing specific subjects if applying for exemptions of specific subjects from the test.

Article 7 (Granting of the Certificate)

(1) A person who passes the test shall receive the certificate specified in the Appendix No. 2 form, the transcript of record in the Appendix No. 3 form, and the certificate in the Appendix No. 3-2 form shall be issued upon request. (2) A person who will graduate from a three-year high civil education center or various schools equivalent to middle school and who passes the test with an exemption of subjects pursuant to Article 15, shall not receive the certificate or transcript of record until he/she graduates from the center or school, and if he/she cannot graduate, then the pass is considered as a partial pass of subjects.

(3) The name of the person who passes the test prescribed in Paragraph (1) shall be published on the public notice of the City and Do, provided, however, that the publication shall be deferred until the person graduates from the center or school if he/she falls under Paragraph (2). (4) The chairman shall inquiry and confirm the academic background of persons who pass all subjects within eighty days from the announcement date.

(5) The chairman shall immediately cancel the pass if any false information is found in respect to the academic background as a result of the academic background inquiry pursuant to Paragraph (4). [Whole provision amended on Dec. 14, 1977]

Article 8 (Acknowledgement of a Partial Pass) The test acknowledges a person who passes partially, and the partial passer may receive a certificate of a partial pass in the Appendix No. 4 form upon request, (including requests through telecommunication networks).

Article 9 (Partial Exemption on Subjects) The partial passer specified in Article 8 may be exempted for the subject in the subsequent test upon request, and the record of the exempted subjects shall be added to the record of the test. Article 10 (Decision on the Passing of the Test) The criteria for passing and partial passing are as follows:

1. When the records of whole subjects are more than 60 points on average against 100 points of a perfect score per subject, he/she passes the test;

2. In order to pass one subject, the points shall be more than 60. Article 11 (Amendment or Re-issuance of the Certificate) (1) If any person who receives the certificate has a good reason to amend the certificate or receive it again, then he/she may request, (including requests through telecommunication networks), the amendment or re-issuance of the certificate to the chairman of the committee with the reason stated.

(2) If any person requests to amend or re-issue the certificate specified in Paragraph (1), the public official shall check the abstract of census register or certificate of resident registration, (only in the case of a name change), through the common use of administrative information as specified in Article 21, Paragraph (1) of the "Act on the Promotion of Electronization of Administrative Affairs to Realize Electronic Government." However, if the applicant does not agree to the verification, he/she shall attach the necessary documents. [Whole provision amended on Dec. 14, 1977]

Article 12 (Fees) The matters necessary for the issuance fees of various certificates according to the test shall be decided by Ordinance of the City/Do.

Article 13 (Actions on a Person Who Makes a False Act)

(1) A person who makes a false act or forges documents in regard to the test shall be disqualified from the test and may not take the test for two years. (2) If a false act as specified in Paragraph (1) is discovered after the test, the pass is cancelled, and the effect of the certificate shall be nullified.

Article 14 (Return of Documents) Documents submitted and fees paid shall not be returned for any reason. Article 15 (Exemption of Subjects) (1) A person who graduated or will graduate from a three-year course high civil education center or various schools equivalent to middle school may be exempted from the test on subjects other than Korean language, mathematics, and English among the subjects specified in Article 5 upon his/her request. (2) A "person who will graduate" means a person who is in the highest grade of the school.

Article 16 (Exhibition of a Ledger)

The chairman of the committee shall prepare a ledger for those who pass the General Educational Development for Qualifications to Enter High School in the Appendix No. 5 form and the ledger for the transcript of the General Educational Development for Qualifications to Enter High School in the Appendix No. 6 form and exhibit them to the committee.

Addendum (Partial Amendment of Enforcement Rules of the Lifelong Education Act to Use Administrative Information Commonly and Reduce Documents)

This rule shall enter into effect on the date of its promulgation.
