RULES ON INTERNATIONAL SCIENCE AND TECHNOLOGY COOPERATION

RULES ON INTERNATIONAL SCIENCE AND TECHNOLOGY COOPERATION [Enforcement: Jun. 26, 2009] [Presidential Decree No. 21551, Jun. 25, 2009, Amendment of Other Laws and Regulations]

Article 1 (Purpose)

The purpose of this Decree is to prescribe necessary matters concerning the science and technology cooperation pursuant to Article 18 of the Framework Act on Science and Technology.

Article 2 (Definitions)

The definitions of terms used in this Decree shall be as follows:

1. The term "science and technology(hereinafter referred to as "S&T") internationalization program" means the international joint research project under subparagraph 2, the foundation laying project for S&T internationalization under subparagraph 3, and the policy research, planning, evaluation and management works for S&T internationalization;

2. The term "international joint research project" means research projects implemented by the Government, local government, corporation, organization or individual of Korea jointly with the government, corporation, organization or individual of foreign country through combined input of S&T resources such as "research and development(hereinafter referred to as "R&D") costs, manpower, facilities, equipment, materials and information required for the same R&D subject;

3. The term "foundation laying project for S&T internationalization" means projects falling under each of the following items which are implemented by the Minister of Education, Science and Technology to facilitate S&T cooperation: a. Establishment of research institutes abroad, such as local research and cooperation center in a foreign country, etc. or support for inducement of foreign research institutes into Korea;

b. Exchange of S&T manpower, such as inducement and utilization of scientists and engineers who are either overseas Koreans or foreigners, and dispatch of Korean scientists and engineers abroad;

c. Collection and utilization of information on science and technology; d. Participation in international (multilateral) S&T cooperation program and project; e. Other foundation laying works needed to facilitate S&T internationalization. Article 3 (Relations with Other Laws and Regulations) The international S&T cooperation program shall be governed by this Decree, unless specially provided for in other laws and regulations.

Article 4 (Promotion of S&T Internationalization Program, Etc.) (1) The Minister of Education, Science and Technology may promote S&T internationalization program to facilitate internationalization of science and technology. (2) The Minister of Education, Science and Technology shall, pursuant to the S&T basic plan under Article 7 (1) of the Framework Act on Science and Technology (hereinafter referred to as the "Act"), formulate detailed implementation plan per year to promote S&T internationalization program, and execute such implementation plan.

(3) The Minister of Education, Science and Technology may designate the institutions and organizations falling under each of the following subparagraphs as specialized institution under Article 18 (2) of the Act (hereinafter referred to as the "specialized institution"):

1. Korea Institute of S&T Evaluation and Planning established under Article 20 of the Act; and

2. National Research Foundation of Korea under the National Research Foundation of Korea Act.

3. Deleted. (4) The Minister of Education, Science and Technology may have a specialized institution perform assistance work required for planning, evaluation and management of S&T internationalization program, by concluding an agreement with the institution.

(5) The Minister of Education, Science and Technology may conclude an agreement with the institution or organization falling under each of the following subparagraphs, concerning S&T internationalization program and for each subject of the program, and have the institution or organization execute such program:

1. Institution or organization falling under each subparagraph of Article 7 (1) of the Technology Development Promotion Act;

2. Other institution or organization deemed by the Minister of Education, Science and Technology as suitable to execute the subject of S&T internationalization program. (6) Matters concerning the method to conclude agreement, contents to be included in the agreement, etc. under paragraphs (4) and (5) shall be as prescribed by the Rules on Management, etc. of National R&D Project. Article 5 (Promotion of S&T Cooperation)

The Minister of Education, Science and Technology Government may promote the matters falling under each of the following subparagraphs to facilitate cooperation in science and technology: Provided, that for the cases of subparagraphs 1 and 2, the said Minister shall consult in advance with the Minister of Foreign Affairs and Trade:

1. Organization and operation of S&T joint committee in accordance with agreement on S&T cooperation concluded with foreign country;

2. Promotion of assistance projects, such as technical assistance and fosterage of manpower, for developing countries and countries with natural resources;

3. Mutual dispatch of technology research teams per major specialized field, and co-host joint seminar; and

4. Other matters on strengthening of cooperation with major countries. Article 6 (Dispatch of Domestic Scientists and Engineers Abroad) The Government may dispatch domestic scientists, engineers and the related public officials to foreign countries in order to promote international joint research project or foundation laying project for S&T internationalization, etc.

Article 7 (Security Management in S&T Internationalization Program) (1) The heads of specialized institutions as well as the institutions and organizations under Article 4 (5) shall formulate security measures including matters falling under each of the following subparagraphs, lest any important information such as R&D results should leak outside in any unauthorized manner during implementation of S&T internationalization program:

1. Security measures as to participating researchers;

2. Security measures as to information related to R&D and research facilities; and

3. Security measures in presentation of R&D results. (2) The Minister of Education, Science and Technology may conduct inspection on the security management conditions of the institutions and organizations under paragraph (1), and demand improvement in the cases where vulnerable elements are observed in the security management.

ADDENDA (Enforcement Decree of the National Research Foundation of Korea Act)

Article 1 (Enforcement Date)

This Decree shall enter into force on Jun. 26, 2009. Article 2 Omitted.

Article 3 (Amendment of Other Laws and Regulations) through Omitted.

The Rules on International Science and Technology Cooperation shall be partly amended as follows:

Subparagraph 2 of Article 4 (3) shall become like the following, and subparagraph 3 of the same Article shall be deleted:

2. National Research Foundation of Korea under the National Research Foundation of Korea Act

through Omitted.

Article 4 Omitted.
