ENFORCEMENT DECREE FOR THE SCHOOL LIBRARY PROMOTION ACT

Enforcement Decree for the School Library Promotion Act [Enforcement date: Jun. 19, 2008] [Presidential Decree No. 21282, Jun. 19, 2008, enacted]

Article 1 (Purpose)

The purpose of this Decree is to prescribe all delegated matters pursuant to the Enforcement Decree for the School Library Promotion Act and the necessary matters for its Implementation.

Article 2 (Establishment Process of the Basic Plan, etc.) (1) The Minister of Education, Science, and Technology shall establish a school library promotion basic plan, (hereinafter referred to as the "basic plan"), pursuant to Article 7, Paragraph (1) of the School Library Promotion Act, (hereinafter referred to as "the Act"), until the end of November in the previous year of the commencing year of the basic plan, and notify the contents thereof to the superintendent of offices of education without delay. (2) The superintendent of offices of education shall devise and enforce the Implementation plan, including the matters of the following subparagraphs, in accordance with the basic plan of Paragraph (1) until every January:

1. Implementation results of the Implementation plan of the previous year;

2. Promotion direction for the business of the year;

3. Promotion directions for each business and detailed operation plan; and

4. Other necessary matters for the development of school libraries. Article 3 (Operation of the School Library Promotion Committee) (1) The conference of the School Library Promotion Committee, (hereinafter referred to as the "promotion committee"), shall commence deliberations with the attendance of a majority of the total members and make a decision with a concurrent vote of a majority of those present.

(2) Allowances and travel expenses for the members which attend the promotion committee may be paid within the limit of the budget, provided, that when public officials attend the promotion committee for related affairs, this shall not apply. (3) Any other matters required for the operation of the promotion except for the matters prescribed in this Decree shall be prescribed by the chairman through deliberation of the promotion committee.

Article 4 (Establishment and Operation of the School Library Developmental Committee)

(1) The School Library Developmental Committee shall be organized by more than 9 and less than 11 commissioners, including a chairman, and the chairman shall be elected from among the commissioners.

(2) The competent superintendent of offices of education shall appoint or entrust the commissioners among the persons outlined in the following subparagraphs, and the term of office of the entrusted commissioners shall be two years:

1. The head of a school which belongs to the competent office of education;

2. Public officials of the competent office of education and local government;

3. Parents who have knowledge and experience in the operation of a school library; and

4. Experts in libraries and reading. (3) The promotion committee shall deliberate on matters of the following subparagraphs:

1. Matters concerning the establishment/Implementation of a school library development Implementation plan;

2. Matters concerning the abolition/removal of school library materials; and

3. Matters that the head of the local government, the principal of a school, school library operating committee, special organizations, or experts requested to deliberate in terms of a school library, and matters that the chairman submits to deliberate with a recognition of the necessity for the development of school libraries.

(4) The chairman shall convoke a session of the developmental committee and become the chairman of the committee.

(5) A meeting of the developmental committee shall commence deliberations with the attendance of a majority of the total and resolve agenda items with an affirmative vote of a majority of those present.

(6) The necessary matters which are required for the operation of the developmental committee except for the matters prescribed in Paragraphs (1) to (5) shall be decided by the chairman through a resolution of the committee. Article 5 (Plan/Results Report of Support Expenditure for School Libraries, etc.) The superintendent of offices of education shall report the operation results of support expenditure and corresponding expenditure compared to the operation plan to the Minister of Education, Science, and Technology until the end of March of the following year.

Article 6 (Composition of the Dedicated Department) The staff who have specialized knowledge of school library promotion affairs shall be appointed to the dedicated department in the Ministry of Education, Science, and Technology and the office of education of the City/Do pursuant to Article 12, Paragraph (1).

Article 7 (Librarian Teachers, etc.)

(1) The total fixed number of librarian teachers/practical education teachers or librarian staff, (hereinafter referred to as "librarian teachers, etc."), appointed to schools pursuant to Article 12, Paragraph (2) shall be calculated by one person per 1,500 students.

(2) Where a librarian teacher, etc. is appointed to a school pursuant to Article 12, Paragraph (2), the Minister of Education, Science, and Technology and the superintendent of offices of education shall assign to each school in the priority order in consideration of the following matters of each subparagraph:

1. The number of students in the school;

2. Operational status, such as the scale/number of materials, etc. of the school library; and

3. Number of users of the school library. (3) The scope of duties for librarian teachers, etc. shall be as follows:

1. Affairs concerning the establishment of a school library operation plan;

2. Affairs concerning the school library operation, such as the collection of materials, arrangement, use, and compilation of the budget, etc;

3. Education and guidance for reading instruction and method of use of the school library, etc; and

4. Supporting lessons/study of teachers who use school libraries. Article 8 (Standards of Facilities/Materials, etc.) (1) The standards of facilities/materials with which a school library shall be equipped pursuant to Article 13, Paragraph (3) is as per the following subparagraphs:

1. The location shall be close to the main entrance of a school for easy access;

2. The area shall be more than 100m2 , provided that the superintendent of offices of

education may adjust the area in a certain range that does not interfere with lessons/study of students and teachers in consideration of the number of students, etc; and

3. More than 1,000 kinds of materials shall be prepared in each school and more than 100 kinds of materials shall be supplemented per year. (2) Detailed criteria of facilities and materials which shall be prepared in school libraries under Paragraph (1) shall be determined by the superintendent of offices of education.

(3) Materials which may be disposed of and removed pursuant to Article 13, Paragraph (3) are as per the following subparagraphs:

1. Materials which are deemed unnecessary for storage as materials with no usage value;

2. Materials which are deemed not to be utilized as materials that are damaged, broken, or stained; and

3. Materials which were lost by uncontrollable disaster/accidents and other similar situations applied correspondingly.

Article 9 (Reading Education, etc.)

The Minister of Education, Science, and Technology/the superintendent of offices of education, and the principal of a school shall consider the matters of the following subparagraphs while establishing and enforcing the detailed plan to support reading education and information literacy instruction of a school pursuant to Article 15, Paragraph (1):

1. Utilization of the school library by students;

2. Reading level of students; and

3. Other matters required to support reading education and information literacy instruction for students.

Addenda

Article 1 (Enforcement Date)

This act shall enter into effect on the date of its promulgation. Article 2 (Special Provision Concerning the Establishment Period of the Basic Plan, etc.)

Notwithstanding the provision of Article 2, the basic plan to be executed in 2008 and the Implementation plan shall be established on or before July 31, 2008 and August 31, 2008, respectively.
