Provisions of Shanghai Municipality on the Control of Aerial Advertising by Measures of Aircraft
 
(Promulgated by the Shanghai Municipal People' s Government on February 12, 1999)
    
     Article 1 Purpose
     These Provisions are formulated with a view to strengthening and standardizing the control of aerial advertising by means of aircraft within this Municipality.
     Article 2 Definition
     The aerial advertising by means of aircraft mentioned in these Provisions refers to the commercial advertisements released by means of aircraft such as airships, helicopters or hot-air balloons.
     Article 3 Scope of Application
     Any unit engaged in the business of releasing aerial advertisements by means of aircraft within the jurisdiction of the Municipality shall abide by these Provisions.
     Article 4 Administrative Department
     The Shanghai Municipal Administration for Industry and Commerce (hereinafter referred to as SMAIC) is the department responsible for the supervision and control of aerial advertising by means of aircraft within this Municipality.
     Article 5 Qualifications for Business Operation
     The unit that applies for undertaking the business of releasing aerial advertisements by means of aircraft shall obtain the approval after verification and be registered by the administrative department for industry and commerce, and acquire the business license and the permit for advertising operation.
     Article 6 Application for Permit to Release Advertisement, Its Verification and Approval
     The unit that releases aerial advertisements by means of aerial aircraft (hereinafter referred to as the releasing unit) shall submit an application to the SMAIC before releasing any aerial advertisement by means of aircraft. Without its verification and approval, no aerial advertisement by means of aircraft shall be released.
     Article 7 Requirements for Application
     The unit that applies for undertaking the business of releasing aerial advertisements by means of aircraft shall meet the following requirements:
     1. That has the specified qualifications for releasing advertisement;
     2. That has obtained the ownership or the right of use of the media for aerial advertising by means of aircraft; and
     3. That has been verified and approved by the department of aviation traffic control.
     Article 8 Relevant Documents of Certification
     The unit that applies for undertaking the business of releasing aerial advertisements by means of aircraft shall submit the following documents:
     1. The business license or the permit for advertising operation;
     2. The document of approval from the department of air traffic control;
     3. The certificate that proves the ownership or the right of use of media for aerial advertising by means of aircraft;
     4. The contract of the advertisement releasing; and
     5. The sample copy of the advertisement.
     Article 9 Application Acceptance
     The SMAIC shall make the decision of approval or of disapproval after its verification, and notify the releasing unit in written form within seven working days after receiving the application for the release of aerial advertisements by means of aircraft.
     Article 10 Requirements for Advertisement Releasing
     The releasing unit shall release the aerial advertisements by means of aircraft in strict accordance with the verified and approved region, time and contents.
     Article 11 Special Provision
     The releasing unit shall abide by all relevant stipulations of the Municipality when releasing non-commercial information by means of aircraft.
     Article 12 Notification
     In case the Municipal People' s Government considers it necessary to suspend the release of aerial advertisements by means of aircraft within a specific time and region, it shall notify, through the official communication of its General Office, the department of air traffic control to assist in its enforcement.
     In case any releasing unit that has violated the laws and stipulations of the State and that its release of aerial advertisements shall be suspended according to law, the SMAIC may, after making its decision, notify the department of air traffic control to assist in its enforcement.
     Article 13 Date of Implementation
     These Provisions shall become effective on June 1, 1999.
