Provisions of Shanghai Municipality on the Administration of Matrimonial Registration and Consultation for Its Residents
 
(Adopted at the 6th Session of the Standing Committee of the 11th Shanghai Municipal People's Congress on November 5, 1998, promulgated on November 10, 1998 and becoming effective on December 1, 1998) Article 1 When Shanghai residents require getting married in Shanghai with foreigners, overseas Chinese, the residents in Hongkong Special Administrative Area, and the residents in Macao and Taiwan, or getting divorced of their own will in Shanghai from overseas Chinese, the residents in Hongkong Special Administrative Area, and the residents in Macao and Taiwan, both parties concerned shall go to the municipal civil administrative department to apply for the marriage registration or the divorce registration (together called the matrimonial registration) Article 2 The municipal civil administrative department shall complete the examination within 30 days from the date of accepting the application for matrimonial registration, and inform the two parties concerned in writing. Matrimonial registration shall be granted and a marriage certificate or a divorce certificate shall be issued to those who meet the requirements of matrimonial registration. Within 3 months after receiving the notice to get the certificate, the two parties who meet the requirements of matrimonial registration shall go to the municipal civil administrative department together to get the marriage certificate or divorce certificate. Failure to get the certificate within the prescribed period shall be regarded as the withdrawal of application. If the parties concerned need to extend the time limit for getting the certificates because of the particular circumstances, they shall send written application to and get the consent of the municipal civil administrative department, but the extension may not exceed three months. Article 3 Setting up matrimonial consulting organizations relating to foreigners, overseas Chinese, the residents in Hongkong Special Administrative Area, and the residents in Macao and Taiwan, shall first get the approval of the municipal civil administrative department and obtain the certificate of matrimonial consultation. Article 4 No organizations whatsoever are allowed to carry out matchmaking activities relating to foreigners, overseas Chinese, the residents in Hongkong Special Administrative Area, and the residents in Macao and Taiwan. No individuals are allowed to carry out for profits matchmaking activities relating to foreigners, overseas Chinese, the residents in Hongkong Special Administrative Area, and the residents in Macao and Taiwan. Article 5 Those violating the stipulations in Article 3 and 4 of these Provisions shall be ordered to correct by the municipal civil administrative department, and they are liable to a fine of RMB 10,000 to 50,000 yuan. Serious offenders are liable to a fine of RMB 50,000 to 200,000 yuan, and particularly serious offenders are liable to a fine of RMB 200,000 to 500,000 yuan. The illicit income, if any, shall be confiscated. Article 6 These Provisions shall become effective on December 1, 1998.
