Procedures of Shanghai Municipality on Displaying and Using the National Flag
 
(Promulgated by the Shanghai Municipal People's Government on July 7,1997)
     Article 1 (Purpose and Basis)
     The present Procedures are formulated in accordance with the "National Flag Law of the People's Republic of China" , and in line with the actual situations in Shanghai, to uphold the dignity of the national flag and enhance the administration of hoisting, flying, and using the national flag.
     Article 2 (Scope of Application)
     The present Procedures are applicable to the hoisting, flying, using and administering of the national flag in Shanghai.
     If there are other state regulations on hoisting, flying and using the national flag, these regulations shall be complied with.
     Article 3 (Definition)
     The national flag specified in the present Procedures refers to the National Flag of the People's Republic of China.
     Article 4 (Administration Department)
     The people's governments at all levels take charge of the supervision of hoisting, flying, and using the national flag in their respective administrative area. The relevant administration departments concerned in the government at all levels administer their subordinate units' hoisting, flying, and using of the national flag. The subdistrict offices administer individual persons and other units' hoisting, flying, and using of the national flag.
     Article 5 (Places of Hoisting and Flying the National Flag Every Day)
     The national flag shall be hoisted and flown every day in the following places:
     1.Airports, passenger transport railway stations and passenger transport wharves;
     2.Other p1aces designated by the Municipal People's Government.
     Article 6 (Units Hoisting and Flying the National Flag on Weekdays)
     The following units shall hoist and fly the national flag on weekdays:
     1.The state organs of the Municipality, districts, counties, towns and townships;
     2.Full-time schools
     3.Other units designated by the Municipal People's Government.
     Two or more units the sane building or compound may hoist and fly one national flag.
     Article 7 (Unites Hoisting and Flying the National Flag on Festivals)
     State organs and mass organizations shall hoist and fly the national flag on National day, the International Labor Day, New Year's Day, and during the Spring Festival. If conditions permit, the national flag may also be hoisted or planted or hung on such occasions in other units, enterprises, villager councils, citizen councils, residential compounds (buildings)of towns, and other places for public activities such as squares, parks etc.
     Article 8 (Planting or Hanging the National Flag in Meeting Halls)
     The national flag shall be planted or hung in the major meeting halls of the state organs and mass organizations.
     Article 9 (Occasions of Hoisting and Flying the National Flag)
     The national flag may be hoisted and flown when important celebrations and commemorations, large-scale cultural and sport activities, and large-scale exhibitions are held. It shall be hoisted and flown when the large-scale celebrations are held by the government of the Municipality and the districts and counties.
     Article 10 (Time of Hoisting and Lowering the National Flag)
     The national flag shall be hoisted in the morning and lowered at dusk if it is to be hoisted and flown according to the stipulation in Articles 5,6,7of the present Procedures.
     Article 11 (Weather Conditions under Which the National Flag Need Not Be Hoisted and Flown)
     The national flag need not be hoisted and flown under the following bad weather conditions if it is to be hoisted and flown according to the stipulation of the stipulation of the present Procedures:
     1.Storm, typhoon
     2.Raining days, snowing days
     3.Other bad weather conditions affecting the normal hoisting and flying of the national flag.
     Article 12 (Position of National Flag Hoisted and Flown)
     When the national flag is displayed by a unit, it should be hoisted and flown on the premises of this unit at the entrance of the places, in the playground, or at the highest position of the building.
     When the national flag is displayed together with other flags, it shall be placed in the center or at a higher, more conspicuous position.
     When the national flag is displayed at the same height with more than two other flags, it should be placed:
     1.In the center when flags are arranged side by side or in a curve;
     2.In the front when flags are arranged in a file
     3.In the center opposite the rostrum (or main entrance) when flags are arranged in a circular form round the arena.
     Article 13 (Position of Flying out the National Flag hung out)
     When the national flag is hung out outdoors, it shall be displayed at the entrance of the building or other conspicuous place, with the lower side of the flag 2.5 metres above the ground. When the national flag is hung out with other flags, it shall be placed above other flags, or in the upper, centra1 position.
     When the national flag is displayed indoors, it shall be placed in the attention attracting area. If there is a rostrum or platform within, the national flag shall be displayed above the rostrum or platform.
     Article 14 (Position of an Erected National Flag)
     When the national flag is erected on the floor, it shall be placed at the conspicuous position in the room. In the meeting hall it shall be placed right behind the rostrum or on both sides beside the rostrum. When erected with other flags indoors, it shall be placed higher than the other flags. The flagpole for erecting the national flag may be upright or slant. However, if it is slant, the included angle between the pole and the vertical line shall be less than 20 degrees.
     Article 15 (Setting of the National Flag)
     When the national flag is to be displayed on a table, it may be set in the middle or on both sides of the table, but it shall not be hidden by my other things.
     Article 16 (Ceremony of Hoisting and Flying the National Flag)
     Full-time primary and middle schools shall hold the ceremony of hoisting and flying the national flag at least once a week, except during the vacation. When the school-opening or graduation ceremony is held outdoors, the rite of hoisting and flying the national flag shall certainly be held.
     If the ceremony of hoisting and flying the national flag is to be held at important celebrations and commemorations, large-scale cultural and sport events, and large-scale exhibitions, it shall be held at the opening ceremony.
     The national flag is to be hoisted and flown first at a ceremony if there are other flag to be hoisted and flown at the same time.
     The national flag is to be hoisted and flown first when it is to be hoisted and flown with other flags during the ceremony.
     Article 17 (Proprieties of the national Flag Hoisting Ceremony)
     While the national flag is being hoisted during the national flag hoisting ceremony, the participants shall stand erect facing the national flag and salute it. The national anthem may be played or sung at the same time.
     Article 18 (Provision on Half-masting the National Flag)
     Half-masting the national flag is to be performed in accordance with the provisions of relevant state laws and regulations.
     Article 19 (Producing, Distribution and Reclaiming of the National Flag)
     The national flag shall be produced and distributed by the specific units designated by the Municipal People's Government. No other units and individual persons shall produce or distribute e national flag without authorization.
     When the national flag is damaged or stained, it shall be handed over to the specific units designated by the Municipal People's Government for centralized reclamation.
     Article 20 (Specifications of the National Flag)
     The national flag produced and distributed shall conform to the specifications stipulated by the state.
     Article 21 (Persons in Charge of Hoisting, Flying and Using the National Flag)
     The units that hoist, fly and use national flag shall designate specific persons to take charge of hoisting and flying the national flag as well as its daily maintenance and the routine work of taking care of it and of safeguarding it.
     Article 22 (Supervision and Administration)
     The relevant administrative department of the people's government at all levels and the subdistrict offices shall regularly inspect the hoisting, f1ying, and using of the national flag by the units or individual persons within their respective administrative scope or area.
     The relevant administrative departments at all levels shall instruct those who violate the present Procedures in hoisting, flying and using the national flag to rectify the wrong within a certain period of time, and may put it right directly for those who fail to rectify the wrong in time.
     If any citizen discovers my wrong in violation of the present Procedures, he/she has the right to make suggestion of rectification directly to the units and individual persons that hoist, fly, and use the national flag, or he/she may report to the relevant administrative departments at all levels.
     Article 23 (Administrative Measures)
     The violation of the present Procedures in producing and distributing the national flag without authorization shall be penalized by the industrial and commercial administration department in accordance with relevant regulations.
     The violation of the present Procedures in producing and distributing substandard national flags shall be penalized by the product quality supervision and administration departments in accordance with relevant regulations.
     Article 24 (Date of Implementation)
     The present Procedures shall become effective on September 1,1997.
