Interim Provisions of Shanghai Municipality on the Administration of Blue-Stamped Residence Registration
 
(Approved by the Shanghai Municipal People' s Government on December 23, 1993, and revised in accordance with the Decision of the Shanghai Municipal People' s Government on the Revision of the Interim Provisions of Shanghai Municipality on the Administration of Blue-Stamped Residence Registration)
    
     Article 1 (Purpose and Basis)
     These Interim Provisions are formulated in accordance with relevant provisions of the State and in light of the actual circumstances of this Municipality to meet the needs of establishing a system of socialist market economy and to strengthen the administration of temporary residents from outside of Shanghai.
     Article 2 (Scope of Application)
     The term "blue-stamped residence registration" as defined in these Provisions refers to the residence registration certificate evidencing resident registration status, which is affixed with a blue stamp by a public security organ after its approval of registration, for the person with the required qualifications from other province or city, who has made investment, purchased commodity dwelling house, or has been employed by a unit in this Municipality.
     Blue-stamped residence registration does not apply to persons from abroad.
     Article 3 (Competent Departments and Relevant Departments)
     The public security organs in this Municipality are the competent administrative departments responsible for the administration of blue-stamped residence registration. The relevant government functional departments at all levels shall do a good job in the administration of blue-stamped residence registration.
     Article 4 (Requirements for Application Under Investment Category)
     A person who has made investments in this Municipality may apply for one blue-stamped residence registration for himself/herself or for his/her relative or his/her employee from other province or city if he/she satisfies one of the following conditions:
     1. A foreigner or a person from Hong Kong, Macao, or Taiwan has made an investment reaching USD 200,000 in this Municipality and the relevant project after its completion, has been put into production, operation or use for business for more than 2 years;
     2. A unit or individual from other province or city has made an investment reaching RMB 1,000,000 in the downtown area or Pudong New Area in this Municipality and the relevant project after its completion, has been put into production, operation or use for business for more than 2 years; or
     3. A unit or individual from other province or city has made an investment reaching RMB 500,000 yuan in the districts of Jiading, Minhang, Baoshan, Jinshan, or Songjiang, or the counties of Nanhui, Fengxian or Qingpu in this Municipality or has made an investment reaching RMB 300,000 yuan in Chongming County and the relevant project after its completion, has been put into production, operation or use for business for more than 2 years.
     The relative referred to in the preceding Section must be the spouse of the investor or the investor' s or his/her spouse' s lineal relative or collateral relative within 3 generations.
     The employee from other province or city referred to in the first paragraph of this Article must be a managerial person or a technically skilled operator employed by the investor.
     For every increase of 100% in the investment, the investor may apply for one more blue-stamped residence registration.
     If the spouse and the minor children of the investor who has applied for blue-stamped residence registration under Paragraph 1 of this Article want to acquire blue-stamped residence registration, the investor must increase his/her investment by the same amount.
     Article 5 (Requirements for Application Under House-Purchasing Category)
     An individual from other province or city who has purchased commodity dwelling house in this Municipality may apply for one blue-stamped residence registration for himself/herself or for his/her spouse or his/her spouse' s lineal relative if the construction area or the total price of the house purchased meets one of the following conditions:
     1. The construction area of a unit house in this Municipality reaches 70 square meters or the construction area of a unit house in Pudong New Area reaches 65 square meters;
     2. The total price of a unit house reaches RMB 350,000 in downtown areas, or the total price of a unit house reaches RMB 320,000 in the Xiao Lujiazui District of Pudong New Area;
     3. The total price of a unit house reaches RMB 180,000 in the district of Minhang, or Baoshan, or Jiading, or the total price of a unit house reaches RMB 160,000 in areas outside the Xiao Lujiazui District but within the Inner Ring Road of Pudong New Area; or
     4. The total price of a unit house reaches RMB 100,000 in the district of Jinshan or Songjiang, or in areas outside the Inner Ring Road of Pudong New Area, or in the county of Nanhui, or Fengxian, or Qingpu, or Chongming.
     If the conditions set in the preceding paragraphs are met, the house purchaser who is an individual from abroad may apply for one blue-stamped residence registration for his/her spouse, or his/her spouse' s lineal relative, or collateral relative within 3 generations; the house purchaser who is a unit may apply for one blue-stamped residence registration for its employee.
     The blue-stamped residence registration applied for under Sections 1 and 2 of this Article shall be entered in the district/county where the purchased house is located and no removal is allowed within 3 years.
     Article 6 (Requirements for Application Under Employment Category)
     A person from other province or city who has been employed by a government organ, an enterprise, an institution or a social group (hereinafter referred to as a unit) may apply for a blue-stamped residence registration if the following conditions are met:
     1. Having obtained an intermediate or a higher professional or technical title;
     2. Possessing the managerial ability or technical skill as urgently needed by the employer unit;
     3. Having been employed by a unit for more than 3 consecutive years with achievements in his/her work; and
     4. Having a fixed legal dwelling place in this Municipality.
     If a person has held blue-stamped residence registration for 2 full years under the provisions of the preceding Section, his/her spouse and one of his/her minor children may apply for blue-stamped residence registration.
     Article 7 (Materials for Application)
     A person applying for blue-stamped residence registration shall submit a notarial certificate evidencing that the applicant has no record of reeducation through labor or criminal sanction, and also family planning, sanitation and anti-epidemic certificates.
     Article 8 (Application Procedures for Investment Category)
     A person applying for blue-stamped residence registration under the provisions of Article 4 shall submit the following documents:
     1. Capital verification report issued by a qualified capital verification agency;
     2. Business license issued by an administrative department of industry and commerce;
     3. Letter of recommendation from the investor;
     4. Reference letter from the investor affirming that the applicant is a managerial person or a technically skilled operator;
     5. Notarial certificate issued by a notary public department evidencing the kinship with the investor or his/her spouse;
     6. Certificate of a fixed legal dwelling place in this Municipality; and
     7. Certificate of household register from the place where the applicant' s permanent residence is located.
     Article 9 (Application Procedures for House-Purchasing Category)
     A person applying for blue-stamped residence registration under the provisions of Article 5 shall submit the following documents:
     1. Title deed to real estate and certificate of the total price of the purchased house issued by a real estate exchange regulatory organ;
     2. Notarial certificate issued by a notary public department evidencing the kinship with the house purchaser or his/her spouse; and
     3. Certificate of household register from the place where the applicant' s permanent residence is located.
     Article 10 (Application Procedures for Employment Category)
     A person applying for blue-stamped residence registration under the provisions of Article 6 shall submit the following documents:
     1. Certificate of intermediate or higher professional or technical title;
     2. Certificate of for qualification for technical skills issued by the labor, personnel or other department;
     3. Certificate of length of employment, managerial ability and achievements accomplished issued by the employer unit;
     4. Certificate of a fixed legal dwelling place in this Municipality; and
     5. Certificate of household register from the place where the applicant' s permanent residence is located.
     The spouse or minor children of a person who has acquired blue-stamped residence registration under the provisions of Paragraph 1 of Article 6 shall submit notarial certificate evidencing husband-wife or parent-child relationship when applying for blue-stamped residence registration.
     Article 11 (Procedures of Examination and Approval)
     A person applying for blue-stamped residence registration shall submit a written application to the public security agency in the applicant' s dwelling place in this Municipality. The agency shall attend to the registration formalities after obtaining approval from the district/county public security organ.
     Article 12 (Treatment for Blue-stamped Residence Registration)
     A blue-stamped residence registration holder shall be entitled to the same treatment as a permanent resident registration holder in this Municipality in being admitted to nursery, kindergarten, and school at compulsory education stage, and in applying for business license, gas and telephone service, etc..
     Article 13 (Obligations)
     A blue-stamped residence registration holder shall abide by the laws and regulations of the State and those of this Municipality.
     Article 14 (Procedures of Alteration)
     A blue-stamped residence registration holder who needs to change his/her dwelling place or working unit for justifiable reasons shall, within 5 days, go through the alteration formalities with the public security organ.
     Article 15 (Annual Review)
     A blue-stamped residence registration holder shall once every year go to the public security agency at the place where his/her dwelling place is located for registration review. He/she shall provide appropriate documents for the review.
     Article 16 (Stipulations for Cancellation)
     The blue-stamped residence registration may be canceled by the public security organ if any of the following circumstances arises:
     1. The investor withdraws his/her investment, wholly or partly, or transfers his/her shares of the investment if the relevant project after its completion has been put into production, operation or use for business in less than 5 years;
     2. The purchaser of commodity dwelling house sells or leases his/her house in less than 3 years after acquisition of real estate title deed;
     3. The holder has not been re-employed by a unit in this Municipality in 1 year after being dismissed by the original unit;
     4. The holder is prosecuted for criminal liabilities or subjected to reeducation through labor or punished by detention for public security reasons;
     5. The holder breaks the family planning policy; or
     6. Other circumstances that warrant the cancellation according to the provisions of the Municipal People' s Government.
     Article 17 (Requirements for Permanent Residence Application)
     Having held blue-stamped residence registration for 3 years or more on account of investment or house purchase, or having held blue-stamped residence registration for 5 years or more on account of employment by a unit in this Municipality while having a fixed legal dwelling place in this Municipality, the holder may according to the relevant provisions apply to the public security organ for permanent residence registration in this Municipality.
     The person approved for permanent residence registration in this Municipality shall pay city construction fees as stipulated.
     Article 18 (Quota Control)
     Shanghai Municipal Public Security Bureau shall, in light of the needs of the municipal economic and social development and in accordance with the population policy of the State and this Municipality, exercise control over the annual quota of blue-stamped residence registrations and the annual quota of permanent residence registrations for the blue-stamped residence registration holders who apply for a change of their residence registration status.
     Article 19 (Obligations of Law Enforcement Personnel)
     In implementing these Provisions, staff members of public security organs shall strictly abide by the law and observe disciplines and enforce the law impartially. Anyone who practices favoritism and malpractice for personal gains and accepts bribes or perverts the law shall be given disciplinary sanction, if his/her act constitutes a crime, he/she shall be prosecuted for criminal liability according to law.
     Article 20 (Interpretation of Application)
     Shanghai Municipal Public Security Bureau shall be responsible for the interpretation of the specific application of these Provisions.
     Article 21 (Date of Implementation)
     These Interim Provisions shall become effective on February 1, 1994.
