Decision of the Standing Committee of the Shanghai Municipal People's Congress Regarding the Strengthening of the Administration of Basic Communication Cable Tubes and Lines in This Municipality
 

(Adopted at the 20th Session of the Standing Committee of the 11th Shanghai Municipal People' s Congress on July 13, 2000) With a view to standardizing the administration of the basic communication cable tubes and lines in this Municipality, ensuring the comprehensive utilization of resources in basic communication cable tubes and lines, and accelerating the process of building an information-based national economy and society in accordance with lawŁ¬the Standing Committee of the 11th Shanghai Municipal People' s Congress, having considered at its 20th Session the draft Decision Regarding the Strengthening of the Administration of Basic Communication Cable Tubes and Lines in This Municipality proposed by the Municipal People' s Government, has made the following decision:

I. All basic communication cable tubes and lines in this Municipality shall be planned, constructed and administered on a unified basis. Basic cable tubes and lines as mentioned in the present Decision refer to the underground tubes (including manholes) through which pass optical (electrical) cables of the communication network inside the red planning lines of urban roads of this Municipality, as well as to the permanently-laid optical (electrical) cable lines of the communication network attached to public facilities, such as the Metro, tunnels and urban bridges.

II. Shanghai Municipal Office for Informatization (hereinafter referred to as the Municipal Informatization Office) is the competent administrative department for building an information-based national economy and society in this Municipality, and is responsible for the formulation of plans of basic communication cable tubes and lines in this Municipality and for the supervision and administration of the construction and operation of basic communication cable tubes and lines in this Municipality.

III. Plans of basic communication cable tubes and lines in this Municipality shall be formulated by the Municipal Informatization Office in conjunction with other competent administrative departments on the basis of the long-term and medium-term national economic and social development plan of this Municipality, taking into account the needs of society at large for such lines, and incorporated into the overall urban plan of this Municipality after comprehensive balancing by the municipal planning and administrative departments.

 IV. The Municipal Informatization Office shall formulate annual plans for the construction of basic communication cable tubes and lines in this Municipality jointly with other relevant departments and organize, coordinate, and supervise their implementation. The formulation of annual plans for the construction of basic communication cable tubes and lines in this Municipality shall be based on the general plan of basic communication cable tubes and lines in this Municipality, take into full account the needs of operating units of different networks and other sectors of society for these lines, and integrated with related annual plans for urban construction.

 V. It is necessary to make full use of the existing resources in basic communication cable tubes and lines in this Municipality. Newly constructed, expanded or renovated basic communication cable tubes and lines shall be interconnected with related existing basic communication cable tubes and lines on the basis of mutual benefit and reciprocity.

VI. In case of any disagreement between relevant provisions of regional laws and regulations of this Municipality, such as the Regulations of Shanghai Municipality on the Protection and Development of Postal and Telecommunication Services, and the present Decision shall prevail.

VII. The present Decision shall become effective on August 1, 2000.
