Rules On the Shenzhen Export Processing Zone

(Adopted at the twelfth permanent meeting of the Third Session of Shenzhen Municipal People' s Government on October 8, 2000, promulgated by Decree No.98 of Shenzhen Municipal People' s Government on December 1, 2000)

Article 1  These rules are formulated to accelerate the development of the Shenzhen Export Processing Zone and to create good investment environment.

Article 2  The Shenzhen Export Processing Zone (hereinafter referred to as "EPZ" ) is a  particular blocked zone that approved to establish by the State Council and supervised by the Customs. EPZ locates in the west part of the first development area of Shenzhen  Longgang Great Industry Zone, from Shenshan Road on its west to Lvyin Road on its east and from Danzi Road on its north to Jinniu Road on its south,3 square kilometres altogether. EPZ may be extended on the basis of the need of development of EPZ and with approval of State Council.

Article 3  The establishment, management and administration of the enterprises in EPZ shall comply with the national laws, rulesand policies that concerned.

Article 4  EPZ shall provide the investors with fine invest environment, perfect general pubic utilities project such as land leveling, water and electricity providing, water draining, communications, roads and environment protection etc.

Article 5  The leading group of Shenzhen Longgang Great Industrial Zone and EPZ is a decision and coordination body of EPZ. Mayor holds concurrent post as the group-leader and there are several vice group-leaders as well. The members of group shall be the persons in charge of relevant municipal function departments.

Article 6  Powers and duties of the leading group are:

(1) to examine and approve the development programme and annual financial plan of EPZ;

(2) to make decision and implement supervision on important matters of EPZ;

(3) to coordinate and deal with the important matters of development, construction and administration of EPZ.

Article 7  Management committee of EPZ is established under the leading group as the agency of municipal government. Management committee of EPZ shall exercise municipal economic management powers and shall be in charge of administrative affairs of the EPZ. Director of the EPZ Management Committee shall be concurrently held by head of Longgang Great Industrial Zone Management Committee.

Article 8  Powers and duties of EPZ Management Committee are

(1) to draft EPZ' s overall plan and programmes of industrial development, land use, informatizating construction, urban design environmental protection ect., to draw up concrete management measures that concerned, and to implement them with the approval of municipal government according to legal procedure;

(2) to examine and approve investors investing projects in EPZ according to prescribed powers;

(3)to be in charge of examining and approving of management of the processing trade business in EPZ and the import and export of goods and articles of the enterprises in the light of national authorization;

(4) to be in charge of the administration of granting builder' s license ,and checking and accepting completed project in EPZ under the direction of municipal administrative section for construction;

(5) to be in charge of the management of labor, personnel and social safeguard of EPZ. To draft annual recruitment plan according to necessity, and to deal with matters such as employing ,examining and approving of recruitment and transference with approval of municipal administrative departments for personnel and labor;

(6)to be in charge of the administration of finance and municipal state-owned assets in EPZ;

(7)to go through prophase formalities involving that Chinese staff in EPZ to go abroad short-termly and to go to Hong Kong, Macao or oversea for training, and to apply for examination and approval of municipal foreign affairs department;

(8)Other powers granted by municipal government.

Article9 Management Committee may entrust development and management company in Shenzhen Longgang Great Industry Zone to undertake administration of developing construction and realty management in EPZ.

Article 10  Export processing enterprises, storage enterprises which especially offer services for producing and operating of export processing enterprises and transportation enterprises approved by Customs which especially transport goods from or to EPZ shall be established in EPZ.

Article 11 Management Committee of EPZ and relevant government departments shall examine and approve enterprises' projects establishment, sign land use contract, go through formalities involving construction application etc., which shall be completed within fifteen workdays.

Article 12  These rules shall be effective as of the day issued.
