Administrative Provisions on Fire Control of High-rise Building
of Shenzhen Special
Economic Zone

by Shenzhen people' s government on August 9, 1985; revised and
promulgated by Decree
No. 21 of Shenzhen people' s government
on January 29, 1994. |

|
|
Article
1
In order to protect the safety of people' s life and
property, insure the smooth progress of modernization
construction in Shenzhen Special Economic Zone (hereinafter
referred to as the special zone), these provisions
are
formulated according to the Regulations on Fire Control of
People' s Republic of China, and
on the basis of actual
situation of the special zone. |

Article
2 These
provisions shall be applicable to dwelling house having more
than ten floors (including ten
floors), and other building for
civil use whose building height exceeds 24 meters. User of the
high-rise building shall comply with these provisions. |
|
|
|
Article
3
If the high-rise building having been put into use does
not meet the safety standard of fire control, it shall be
rectified and improved according to the requirements stipulated
in the Notice of Rectification
and Improvement of Fire Dangerous
or Hidden Danger issued by the supervision organ of public
security
and fire control (hereinafter referred to as fire
control organ). |

Article
4 Management
Office of high-rise building shall employ full time fire control
manager according to
the jurisdiction extent of fire control
center. |
|
Fire control manager shall be person of age between 18
and 45, having healthy body and good morality, having accepted
education of or above the level of senior middle school, being
examined as qualified by employing
unit and trained on fire
control operation, and having acquired the certificate of
fireman. |
|
Fire control manager shall work under the leadership of
administration office and the operation guidance of fire
control
organ. |
|
|
|
Article
5
The responsibilities of full time fire control manager
are: |
|
1.
propagandizing fire prevention and popularizing fire control
knowledge; |
|
2.
implementing system and regulations, carrying out safety check
of fire prevention, correcting
behavior against fire control and
rectifying hidden danger of fire danger; |
|
3.
supervising operation with fire; |
|
4.
managing facilities and equipments of fire control; |
|
5.
managing fire control center well, carrying out supervisory
control all day long and guaranteeing
the good condition of
every equipment at any time; |
|
6.
using fire control safety facility to fight against fire at the
same time of calling fire control
organ after getting fire
alarm. |
|
|
|
Article
6
The responsibility system of fire control shall be
carried through in comprehensive building with numerous users
or
complex functions. Manager or responsible executive of each user
is the person responsible for
fire control, taking charge of
fire control in respective area under the guidance of fire
control
organ and fire control manager of the building. Their
responsibilities are: |
|
1.
implementing relevant laws and regulations on fire control,
carrying out every safety measure
for fire prevention; |
|
2.
establishing responsibility system of fire prevention on post,
often examining employer' s safety
working situation of fire
prevention; |
|
3.
urging employer to use fire, electricity safely, and well
managed dangerous inflammables or explosives
according to
regulations; |
|
4.
removing hidden fire danger by fixed person, fixed time and
fixed measure; |
|
5.
examining, repairing and maintaining fire control facility and
equipment regularly; |
|
6.
assisting public security organ to investigate the reason of
fire actively and raising settlement
opinion. |
|
|
|
Article
7
Stairway, corridor and exit shall be kept unblocked, and
shall not be taken up or blocked by any unit or individual. |
|
|
|
Article
8 Safety
evacuation sign and illumination equipment for accident of
stairway, corridor and exit shall
be taken good care of. |
|
|
|
Article
9
All users are prohibited to sell or store inflammables
and explosives, such as fireworks, firecracker, dynamite,
gasoline and banana oil, and various highly toxic goods. |
|
|
|
Article
10
Fitment in sub fire control area not exceeding 50 square
meter shall be examined and approved by management office
of the
building. If fitment exceeds 50 square meter, it shall be
submitted for examination and
approval to fire control organ.
And shall not be started until being approved. |
|
|
|
Article
11 User
shall comply with safety provisions and is prohibited to set up
or connect provisional electric
wire without order when it
requires to set up new electric wire for electrical equipment in
indoor
fitment. |
|
|
|
Article
12
User is prohibited to use bottled gas if he is able to
use pipelined gas. |
|
|
|
Article
13 Anyone,
who wants operating with fire, such as welding, shall apply to
fire control organ for approval,
and operate under the
supervision of fire control manager of the building after being
approved. |
|
|
|
Article
14
Public location in high-rise building, such as guest
room, barroom, coffee room, dining room, music hall and shopping
place, shall be equipped with sketch map of evacuation both in
Chinese and English. |
|
|
|
Article
15 In
case of the following circumstances, the unit liable shall be
imposed a fine of more than 2,000
yuan but less than 5,000 yuan,
the person liable for fire control and the person directly
liable
shall be imposed a fine of more than 200 yuan but less
than 500 yuan, the user shall be imposed a fine of more than
100
yuan but less than 1,000 yuan and may be imposed administrative
detention within 10 days simultaneously: |
|
1.
taking up or blocking stairway, corridor or safety evacuation
exit; |
|
2.
shutting or damaging safety evacuation sign, illumination
equipment for accident or fire control
symbol; |
|
3.
using bottle gas in violation of provisions; |
|
4.
setting up or connecting electric wire without order; |
|
5.
embezzling fire extinguishing tool, facility or standby water
resource without authority; |
|
6.
starting operation with fire without being examined and
approved; |
|
7.
not carrying out safety protection measure in operation with
fire, electricity or of welding. |
|
|
|
Article
16
Anyone, who commits any one of the following behaviors,
shall be ordered to suspend business, and imposed a fine
of more
than 10 yuan but less than 20 yuan per square meter according to
the seriousness of situation.
The person liable for fire control
(or the person mainly in charge of unit) shall be imposed a fine
of more than 200 yuan but less than 500 yuan, user shall be
imposed a fine of more than 200 yuan but less than
500 yuan, and
may be imposed administrative detention within 10 days
simultaneously: |

1.
starting indoor fitment without being examined and approved; |
|
2.
material used in indoor fitment does not meet fire control
requirement or not being handled to
prevent fire. |
|
|
|
Article
17
Anyone, who changes the function of fire control facility
without authority, or refuses to rectify and reform according
to
requirements in the Notice of Rectification and Improvement of
Fire Dangerous or Hidden Danger
issued by fire control organ,
shall be ordered to rectify and reform. According to the
seriousness
of situation, the unit shall be imposed a fine of
more than 2,000 yuan but less than 5,000 yuan, the person liable
for fire control (or the person mainly in charge of the unit)
shall be imposed a fine of more than
500 yuan but less than
2,000 yuan, the user shall be imposed a fine of more than 100
yuan but less
than 1,000 yuan, and may be imposed administrative
detention within 10 days if the situation is serious. If the
behavior commits a crime, criminal responsibility shall be
investigated according to law. |

Article
18 All
users shall comply with the fire control management of fire
control manager of fire control
organ and management office of
the building. Relevant person in charge of unit or person
directly
liable shall be imposed a fine of more than 500 yuan
but less than 2,000 yuan according to the seriousness of
situation, and shall be imposed administrative detention if the
situation is serious, or even be
investigated criminal
responsibility according to law, if he creates difficulties
intentionally,
abuse working staff of fire control supervision,
or hinder them to implement their duties through violence or
threat. |

|
Article
19
Penalty imposed on unit or individual violating these
provisions shall be decided by the municipal organ of public
security and fire control. If the party does not agree with the
penalty decision, he may apply
for review to the municipal
bureau of public security with 15 days upon reception of the
decision.
If the party does not agree with the review decision,
he may bring litigation before people' s court within 15 days
upon reception of review decision. |

Article
20 These regulations shall enter into effect as of the date of
promulgation. |
