Measures for Management and Use of Foreign Expert

In accordance with the document of Strengthening the Management of Foreign Expert Certificate (WZF[1996] No. 173) issued by the State Administration of Foreign Experts Affairs and the document on the Management and Use of Foreign Expert Certificate (YWZZ [1996] No. 015) issued by Guangdong Foreign Experts Administration and Division of Exit and Entry Administration of Guangdong Public Security Department, the following measures of managing and using Foreign Expert Certificate have been formulated in light of the reality in Guangzhou.

1. Foreign Expert Certificate is printed by the State Administration of Foreign Experts Affairs. Guangzhou Foreign Experts Administration is responsible for the numbering, signing and issuing of Foreign Expert Certificate in Guangzhou.

2. Foreign Expert Certificate is for:

1) Foreign technicians and management personnel who are employed and come along with imported technology and equipments to Guangzhou;

2) Foreign technicians, management personnel and consultants who come to China for aid projects sponsored by such international organizations as the United Nations or multi-lateral or bi-lateral governmental aid projects;

3) Foreign technicians, management personnel and consultants who are employed by state owned enterprises or with national or local fund specifically designated for introducing foreign professionals in order to meet the demands arising from local economic development;

4) Foreign technicians and management personnel engaged in production, operation and management in foreign invested corporations, i.e., foreign experts in foreign invested corporations who are employed in accordance with the Measures for Management of Foreign Experts in Foreign Invested Corporations (WZF [1996] No.176) for jobs suitable for his/her expertise and who shall satisfy the conditions listed below:

a. Holding a bachelor’s degree, an engineer’s title or equivalent degree and title;

b. Having over five years’ experience in the given field and the competence to give technical guidance;

c. Equipped with special skills or other expertise which are urgently needed for the city’s development; and

d. Having over five years’ management experience abroad, holding the post of department manager or equivalent thereof in large or medium-sized foreign invested or high-tech corporations;

5) Foreign cultural and educational experts or those engaged in education, press, publishing, culture, art, public health, and sports and so on in Guangzhou.

3. Employers of foreign experts are required to apply for Foreign Expert Certificate to Guangzhou Foreign Experts Administration by submitting valid passports of the experts and employment certificates produced by the employer within 15 days after the entry of the foreign experts who have successfully applied for the Letter of Confirmation on the Employment of Foreign Experts and obtained an Work Visa (Z). If no Work Visa (Z) is obtained before the experts’ entry, employers shall apply for Foreign Expert Certificate by submitting valid passports of the experts, expertise/degree certificates, employment contracts and employment certificates and then with the obtained Foreign Expert Certificate and other required documents apply for Work Visa (Z) to the Administration Office of Foreigners of Guangzhou Public Security Bureau.

4. Foreign Expert Certificate serves as the identity card for a foreign expert during his/her stay in China. Within 30 days’ after the entry, a foreign expert shall go through settlement procedures at the Administration Office of Foreigners of Guangzhou Public Security Bureau upon showing the Foreign Expert Certificate and other relevant documents. In this case it is not necessary to apply for a Work Permit for Foreigners.

5. Foreign Expert Certificate is valid for no longer than one year. Foreign experts who remain employed by the same organization shall have the certificate renewed at Guangzhou Foreign Experts Administration; Foreign Expert Certificate is automatically invalidated if it fails to be renewed.

6. Should foreign experts be employed by a different organization in China, the previous certificate shall be returned and a new Foreign Expert Certificate shall be obtained through application by the new employer. The Foreign Expert Certificate shall be withdrawn or marked as invalid by the employer when a foreign expert leaves the country.

7. Organizations to recruit experts from Hong Kong, Macau, and Taiwan who satisfy the above-mentioned conditions shall apply for Certificate for Experts from Hong Kong, Macau and Taiwan, which shall be subject to the above-mentioned measures.

8. These Measures shall come into effect as of the day of issuing.

9. Guangzhou Administration of Foreign Experts Affairs reserves the right to interpret these Measures.
