Rules on Automatic Vehicle Detection of Shenzhen Economic
Special Zone |

|
Article
1 These
rules are formulated in order to strengthen the technical
quality detection of automatic vehicles
of Shenzhen Economic
Special Zone, to improve the mechanical performance of vehicles,
and to safeguard
traffic safety.

|
Article
2 The
Vehicle Administrative Station of the Public Security Bureau of
Shenzhen Municipality (hereinafter
referred to as the "Vehicle
Administrative Station" ) is in charge of the work of vehicle
safety
detection of Shenzhen Economic Special Zone.

Article
3 The
units of the following: the "automobile detection center of
Shenzhen Municipality" , the
"automatic vehicle detection
station of automobile repair factory of Materials of Shenzhen
Municipality"
, the " service company of automobile repair
and detection of Shenzhen Municipality" , and the "automatic
vehicle detection station of automobile repair factory of
Dachang of Shenzhen Municipality" , which
are examined and
approved by the "Vehicle Administrative Station" , and
sanctioned by the Provincial
Public Security Department, shall
undertake the detection and annual examination of technical
performance,
quality and safety of vehicle.

In
case that the units specified above have insufficient capability
of undertaking detection, other
production unit which has
detection facilities, technical capability and a perfect system
may,
after examined and approved by the public security
organizations, accept consignment to undertake annual
examination of partial vehicles.

Article
4 The
vehicles imported through ports of Shenzhen shall, after
arrival, be declared for test to the
Commodity Inspection
Bureau, and shall be detected in performance and quality by the
automobile
detection center of Shenzhen Municipality. As to a
vehicle which is not up to standards, a certification shall be
signed and issued by the Commodity Inspection Bureau, which can
be taken as a voucher by the importing
unit to claim an
indemnity to imported unit.

Article
5 If
anyone of other places of the country imports
vehicle via Shenzhen, he shall, basing on the materials of
approval, obtain
temporary license at the branch office of
Wenjindu of the Vehicle Administrative Station.

Article
6
Vehicles made in Shenzhen for export shall, with consent of the
Vehicle Administrative Station,
be made overall technical
appraisal and be detected by the automobile detection center of
Shenzhen
Municipality according to relevant standards. If a
vehicle is up to the standards, The Commodity Inspection Bureau
shall sign and issue the certificate for export for it.

Article
7
Automatic vehicle shall be detected once a year. If it is up to
standards, the Vehicle Administrative
Station shall sign on the
travel license.

|
Article
8 Time of
the annual examination shall be uniformly set by the Vehicle
Administrative Station. Owners
of vehicles shall accept
examination at the detection departments appointed by the
vehicle administrative
organizations of the Public Security
Department within the prescribed time.

Article
9
Items and standards of the annual examination and detection
shall be set down by the Vehicle Administrative
Station
according to relevant national standards and automatic vehicle
detection standards of the
Provincial Public Security
Department, and in line with the actualities of Special Zone.

|
Article
10 Owners
of the detected vehicles are obliged to pay charges according to
provisions made by relevant
departments and detection center.
|
|
Article
11 If a
vehicle, which has not gone through annual examination or fails
to pass the annual examination,
steers on the road, a fine of
neither more than 200 yuan, nor less than 1,000 yuan shall be
imposed.

Article
12 Any of
the detection unit, which violates "National Technical
Qualification of running in safety
for vehicle of standard type
of GB7258-87" , shall be given penalty covering warning,
suspension
of business operations for rectification or even up
to deprival of his detection qualification.

Article
13
If any of the parties dissatisfies with the sanction decision,
he may apply to the Public Security
Bureau for administrative
consideration according to law, and may bring a suit before the
People'
s Count according to law.

Article 14
These provisional rules shall take effective as of the date of
promulgation. |
