RULES GOVERNING SUPERVISION & CONTROL OVER EXPORTATION OF EXHIBITION GOODS BY THE CUSTOMS OF THE PEOPLE'S REPUBLIC OF CHINA

RULES GOVERNING SUPERVISION & CONTROL OVER EXPORTATION
OF EXHIBITION GOODS BY THE CUSTOMS OF THE PEOPLE'S
REPUBLIC OF CHINA

[Article 1] (Omitted)

[Article 2] The exhibits for export referred to in this Procedure include the exhibits and relevant propaganda materials, decorative articles, materials for reception use, small articles for retail and other articles for public use transported abroad for the purpose of holding economic, trade, cultural, scientific and technical exhibitions abroad or participating in foreign exhibitions.

[Article 3] When exhibits are being transported out of the country, the unit which organises the exhibition abroad (or the unit entrusted by it -- the same applies hereinafter) shall submit and declare to the Customs at the place of departure a list in duplicate of the exhibits with such contents as shipping marks, numbers of packages, names, specifications, quantities, prices, etc., and indicating clearly the approval organ and the number of the document of approval, together with the relevant transport documents.

[Article 4] When the exhibits are being transported back to the country, the unit which organised the exhibition abroad shall submit and declare to the Customs at the place of entry a list of the exhibits in duplicate as stipulated in Article 3 herein, indicating clearly the original date and place of departure, name of the means of transport used thereby, the country or district where the exhibits were held, conditions under which the exhibits were dealt with during the period of exhibition abroad such as sales, complimentary disposal, abandonment, consumption or leaving behind for use by the organisations of our country accredited abroad.

If the unit which organised the exhibition abroad requests the exhibits to be delivered to the Customs at the place where the exhibits were originally located for Customs processing, the Customs at the place of entry can deal with the same according to "cargos under Customs supervision".

[Article 5] When exhibits are being transported out of or back into our country, no personal effects or other articles not for exhibition shall be put in the containers of the exhibits.

[Article 6] The articles, samples, gifts and other materials purchased or accepted during the period of exhibition abroad by the unit which organised the exhibition abroad shall be separately packed and a list thereof shall be submitted and declared to the Customs at the place of entry. The document of approval from the Ministry of Foreign Trade for the purchased articles other than the board and lodging articles for communal use by the working personnel abroad shall also be submitted to Customs for examination. Customs shall, according to relevant provisions, levy tariffs on the above-mentioned articles or exempt the same therefrom.

[Article 7] Customs shall carry out necessary inspection of the exhibits transported abroad or back into our country and other articles purchased or accepted abroad. During inspection of the above-mentioned articles by Customs, the unit which organised the exhibition abroad shall be present and open the packages as shall be required by the Customs.

[Article 8] Customs at the place of departure or entry shall clearly state the condition and date of its inspection and clearance of the exhibits in the lists as set out in Articles 3 or 4 herein, one copy thereof to be filed while the other copy thereof is sent to the Customs at the location of the unit which organised the exhibition abroad (the lists shall all be sent to the Beijing Customs) for auditing and closing the case.

[Article 9] If Customs in the course of inspecting and clearing the exhibits and dealing with the work of auditing and closing the case, finds any contravention of the articles herein and other decrees and provisions, it can detain the exhibits concerned, conduct investigations and deal with the same respectively in accordance with relevant stipulations.
