REGULATIONS FOR THE TRIAL IMPLEMENTATION OF
CONTROL OF QUALITY CONTROL PERMITS FOR
MECHANICAL AND ELECTRICAL PRODUCTS FOR EXPORT

CHAPTER I -- GENERAL PRINCIPLES

[Article 1] These Regulations are formulated to reinforce control over the quality of mechanical and electrical products for export, to improve the reputation and competitiveness of China's mechanical and electrical products on the international market and to increase exports and foreign exchange revenue.

[Article 2] These methods apply to key mechanical and electrical products for export, produced by all factories throughout China.üü Detailed product catalogues will be issued separately by the State Bureau of Import and Export Commodities Inspection, in conjunction with the Mechanical and Electrical Product Classification Department.üü A quality control permit for mechanical and electrical products for export (hereinafter referred to as a quality control permit) received by the production factory after the approval of a certain product only means that the said product has met export quality requirements.

[Article 3] The State Bureau of Import and Export Commodities Inspection (hereinafter referred to as the State Commodities Inspection Bureau) and the relevant Mechanical and Electrical Product Classification Department shall take full responsibility for all leadership work involved with the implementation of quality control permits, the organization and co-ordination of all units concerned, the formulation of examination methods to assess products prior to the issuance of a quality control permit, the approval of inspection authorities and the issuances and cancellation of quality control permits.

[Article 4] All products which require a quality control permit must obtain the said permit prior to export and within the time limit stipulated in regulations.üü Without this permit all export, without exception, shall be forbidden.üü In the event of exceptional circumstances, the approval of the State Commodities Inspection Bureau and the relevant Mechanical and Electrical Product Classification Department must be obtained and only then would export be permitted.

CHAPTER II -- CONDITIONS TO BE MET BY FACTORIES IN ORDER TO OBTAIN A QUALITY CONTROL PERMIT

[Article 5] Factories manufacturing mechanical and electrical products for export must meet the following provisions:

(1) complete, consistent and correct drawings of the product, together with technical specifications and inspection rules and regulations;
 
(2) production equipment which guarantees the quality of products, parts and raw materials, technological equipment and measuring implements, checking instruments and testing equipment;
 
(3) a team of specialised technical personnel, technical workers and personnel to undertake measuring and testing who can guarantee the quality of the product, as well as carrying out production, experimental and testing work in strict accordance with blueprint technology and technical standards;
 
(4) establish an efficient system which guarantees the quality of the product prior to making an application for a quality-control permit for the said product;
 
(5) establish an orderly system for administration and examination, together with an ability to balance production responsibilities with the completion of export tasks on time.
 

[Article 6] The quality of mechanical and electrical products for export must comply with current international universal technical standards and, in the absence of international standards, State standards and standards set by the relevant Mechanical and Electrical Product Classification Department (professional standards) should be applied.üü In the absence of any of the above, enterprise standards approved by the relevant department (bureau) in charge should be applied and the first-class product requirements of current quality standards issued by the relevant Mechanical and Electrical Product Classification Department should be met.

If foreign customers have specific requirements, the technical specifications stated in the contract signed by the enterprise and the customer should be used as the basis for inspection of the product for export.

In cases where it is temporarily impossible or inappropriate to apply these quality requirements to standard and non-standard products which have been exported for many years, have maintained stable quality standards and have been well received abroad, the technical conditions for the product for export set by the enterprise may, after approval by the State Commodities Inspection Bureau and the relevant Mechanical and Electrical Product Classification Department, be used as interim implementing standards.

[Article 7] The packaging of mechanical and electrical products for export must meet the packaging requirements of the Ministry of Foreign Economic Relations and Trade, the State Commodities Inspection Bureau and the relevant Mechanical and Electrical Product Classification Department.

CHAPTER III -- INSPECTION AUTHORITIES

[Article 8] Inspection authorities shall be impartial and comparatively independent.üü Following joint examination and approval by the State Commodities Inspection Bureau and the relevant Mechanical and Electrical Product Classification Department, inspection authorities will be officially authorised with the issuance of an authorisation certificate and a special seal to be used in the authorisation of the quality control permit.üü Inspection of the quality of products for export by inspection authorities will be supervised and directed by the State Commodities Inspection Bureau and the relevant Mechanical and Electrical Product Classification Department.üü Inspection authorities are responsible for the inspection of products and the examination of factories during their consideration of a permit application.üü The State Commodities Inspection Bureau and the relevant Mechanical and Electrical Product Classification Department may withdraw the authorisation certificate and the special seal of any inspection authority who has committed a serious work-related mistake.

[Article 9] Inspection authorities are responsible for the inspection of products and the examination of conditions in factories, as well as providing written comments on the suitability of issuance or cancellation of a quality control permit and, after the examination and approval of higher officials, issuing or withdrawing the permit accordingly or sending out a notice of unsuitability.

[Article 10] Inspection authorities are responsible for drafting rules for the implementation of quality control permits for all kinds of mechanical and electrical products for export and, after their approval by the State Commodities Inspection Bureau and the relevant Mechanical and Electrical Product Classification Department, to carry out their implementation.

[Article 11] While engaged in work concerned with the issuance of quality control permits, inspection authorities must abide by the principles of non-profit making and frugality and charge the inspected units on the basis of actual labour and expenditure costs.üü Inspection authorities shall formulate detailed standards of chargeable fees in accordance with the methods determined by the relevant Mechanical and Electrical Product Classification Department regarding the collection of fees and, after their approval by the State Commodities Inspection Bureau and the relevant Mechanical and Electrical Product Classification Department, carry out their implementation.

[Article 12] Inspection authorities shall keep information about the technology of the inspected products and inspection results confidential so as to protect the legal rights of the inspected units.

CHAPTER IV -- PROCEDURES CONCERNING THE APPLICATION FOR AN ISSUANCE OF A PERMIT
