Measures of Beijing Municipality on Water Conservation

Measures of Beijing Municipality on Water Conservation

(Promulgated by Decree No.155 of the People’s Government of Beijing Municipality on March, 15,2005)

Article 1 These Measures are formulated in accordance with the Water Law of the People’s Republic of China and the Measures of Beijing Municipality for Implementing of the Water Law of the People’s Republic of China, for the purposes of strengthening the administration of water conservation, utilizing water resources in scientific and reasonable ways and building a water-saving society.

Article 2 These Measures apply to the water conservation and the administration of water conservation within the administrative area of this Municipality.

Article 3 This Municipality shall strictly carry out water conservation measures, allocate surface water, underground water and recycled water on a unified basis, give play to the role of price on water-using activity regulation, and promote the work of water conservation by taking measures in the fields of administration, economy, engineering and technology in with the light of the principles of planned supply and quota management.

Article 4 The people’s governments at various levels shall set up a responsibility system for water conservation and include the work of water conservation in the national economic and social development plans, improve the socialized service system for water conservation, spread new skills, new techniques and new equipments of water conservation, nurture and develop the water-saving industry, organize and conduct publicity activities on water-conservation, and improve the water-conservation awareness of the whole society.

Every unit and individual shall bear the duty of water-conservation.

Article 5 The competent administrative department of water of the Municipal People’s Government (hereinafter referred to as municipal administrative department on water-conservation) shall be responsible for the unified administration and supervision of water conservation of this Municipality.

The competent administrative departments of water at of the people’s governments at the district and county levels and the departments of water conservation management designated by the people’s governments of districts under which there are no competent administrative departments of water (hereinafter referred to as departments of water conservation administration at the district and county levels) shall be responsible for the supervision and administration of water conservation within corresponding administrative areas within prescribed limits of authority.

The relevant departments of the people’s governments at the municipal, district and county levels shall be responsible for the work related to water conservation within their corresponding administrative areas according to the division of duties.

Article 6 The people’s governments at the municipal, district and county levels shall commend and reward the units and individuals who have made outstanding contributions in water conservation and water conservation.

The departments of water conservation administration at the municipal, district and county levels departments of water conservation administration shall commend and reward the units and individuals who have made outstanding contributions in the research and development of science and technology on water-conservation and in the work of building a water-saving society, water-saving units and water-saving communities.

The unit to which an individual is belonged shall commend and reward him when he has made outstanding contributions in the spreading of science and technology on water conservation and water conservation administration of the unit.

Article 7 The municipal department of water conservation administration shall work out the plan on water conservation of this Municipality and shall organize the implementation of the plan after it is approved by the Municipal People’s Government.

The departments of water conservation administration at the district and county levels shall, in accordance with the water conservation plan of this Municipality, departments of water conservation administration work out the plans on water conservation of corresponding administrative areas and organize the implementation of the plan after it is approved by the people’s governments at the same level.

Article 8 The municipal competent administrative departments of development and reform shall, together with the municipal department of water conservation administration and other departments concerned and based on the present state of water resources, formulate the directorial catalogue for investment projects in the fields of industry, agriculture and service and the list of projects whose development are to be limited with a view to limit the development of such backward and high water-consuming projects in the fields of industry, agriculture and service.

Article 9 The water-use quotas for the production and service of products in relevant industries of this Municipality shall be worked out under the organization by the competent departments of relevant industries and then shall be submitted to the municipal department of water conservation administration and the competent municipal administrative department of quality supervision and inspection for verification and approval; the water-use quotas for the industries without competent department shall be worked out under the organization by the municipal department of water conservation administration and the competent municipal administrative department of quality supervision and inspection.

The water-use quotas for various industries shall be made known to the public by the Municipal People’s Government.

Article 10 The departments of water conservation administration shall, according to the annual water-use plan, the water-use quotas of relevant industries and the needs of the existence, production and operation of water-using units, verify the water-use quotas of water-using units and shall made the water-using quotas for the next year to relevant water-using units before 31st December each year.

New water-using units and water-using projects shall, before being put into use, shall apply to the departments of water conservation administration for the verification of the water-use quotas.

Article 11 If a water-using unit is moved to another place within this Municipality, the verified water-use quota of the unit shall remain to be valid.

If the move of a water-using unit involves the transfer of its water-use quota within this Municipality, it shall go through the procedures for the transfer of the water-use quota at the municipal department of water conservation administration or the department of water conservation administration of the relevant district or county without delay.

Article 12 The amount of water used shall be measured.

The units supplying or using water shall have water measurement facilities installed and shall strengthen the inspection and daily maintenance of these facilities to ensure their accuracy. If damaged, these facilities shall be repaired or replaced without delay.

If there is no water measurement facility in a water-using unit, the department of water conservation administration shall order it to have such facilities installed within a prescribed time limit, and the drawing of water shall be calculated according to the designed water-using capacities of the project or the rated volume of flow of the water-drawing facilities operated without stop, the amount of the water used in the whole period till such facilities are installed from the first day of water using until the water measurement facilities have been installed..

Article 13 If there are more than two types in the water use nature of a water-using unit that shall be calculated according to different prices, it shall have the water measurement facilities installed separately according different of water-using natures.

If a water-using unit fails to calculate the prices on separate terms by failing to have different measurement facilities installed according to different water-using natures, it shall be charged with the highest water price standard of the different water-using types of the unit.

Article 14 A water-using unit shall use water according to the annual water use quota made known to it by the department of water conservation administration; if it exceeds the quota, the departments of water conservation administration shall, apart from the water fees actually paid, charge it with progressive price-plus fees according to the following times based on the actual price standard of the unit:

If the excessive amount is not more than 20% (including 20%) of the prescribed quota, it shall be charged one time of the water price; if the excessive amount is between 20% and 40% (including 40%) of the prescribed quota, it shall be charged with two times of the water price; if the excessive amount is over 40% of the prescribed quota, it shall be charged with three times of the water price.

Article 15 The water-supplying units and other units that directly draw water from rivers, lakes or underground shall, according to the requirements of the departments of water conservation administration, report the water supply or the actual amount of water used without delay and with accuracy.

Article 16 The water-saving facilities of the newly built, expanded or altered construction projects, shall be designed, constructed and put into use at the same time with the principal part of the projects.

While examining and approving the design of a construction project, the competent administrative department of planning shall solicit the opinions of the department of water conservation administration at the same level for the plan of the water-saving facilities; the planning and designing units shall design the water-saving facilities according to the water conservation standards and criteria of the State and this Municipality; the unit examining the construction drawing shall strictly examine the contents related to water conservation.

After the completion of the water-saving facilities, the constructing unit shall apply to the department of water conservation administration for check and acceptance. Where the facilities are unchecked and unaccepted or fail to pass the check and acceptance, they shall not be employed in the construct project, the department of water conservation administration shall not verify the water-use quota, and the water-supplying unit shall not officially supply water.

Water-saving facilities include utensils, techniques and equipments for water using, measurement facilities, recycled water reusing systems and rainwater collecting and utilizing systems.

Article 17 While demolishing urban dwellings and relocating the residents, the unit in charge of the demolishing shall, according to the rate of progress of the demolishing, sign an agreement with the water-supplying unit to stop supplying water and clarify the responsibility of water conservation on the demolishing site.

The water-supplying unit shall take measures concertedly with the construction progress to close down the water supplying pipes on the demolishing site without delay.

Article 18 An industrial water-using unit shall increase the number of times of recycled use of water so as to increase the repeated utilization rate of water by adopting advanced technologies, techniques and equipments. A manufacturing enterprises using water as materials shall reduce the loss of water resources by adopting water-saving techniques and technologies.

The water used for industrial purpose in the areas covered by pipes of recycled water shall be recycled water conforming to the quality demands for the water used.

The indirect cooling water shall be recycled and reused, and the recycle rate shall not be less than 95%.

The rate of productivity of enterprises producing pure water shall not be less than 70% of the material water.

Article 19 The municipal competent administrative departments of agriculture and forestry shall, together with relevant departments, adjust the distribution of agricultural production and the structure of water usage in forestry, animal husbandry and fishery according to the state of the water resources of this Municipality.

The people’s governments at the district and county levels shall, according to the state of the water resources within their corresponding administrational areas, guide the units and individuals of agricultural production and management to make reasonable adjustments to the planting structure of crops, develop highly proficient water-saving farming while restricting and compressing the planting areas of crops that are highly water-consuming and low in profits.

Article 20 The water used for agricultural purposes shall be charged according to the amount. Water measurement facilities shall be gradually installed for rural residential water, water used for the production of village and township enterprises and for irrigating the fields separately for separate measurements in rural areas.

The water used for irrigation of the fields shall adopt pipeline irrigation, seepage-proof tunnels, sprinkling irrigation, micro-irrigation, drip irrigation and other advanced water-saving methods so as to increase the proficiency of water usage.

Article 21 If the water for agricultural purposes is shifted to nonagricultural ways, the water-using unit shall go through the alteration procedures, verify the water-use quotas anew and pay water fees according to the new nature of water-using at the department of water conservation administration.

Article 22 It is encouraged to use rainwater or recycled water satisfying the quality demands as the water for the purpose of afforestation and the use of urban tap water shall be gradually reduced.

The irrigation for urban greenery patches, trees and flowers shall adopt sprinkling irrigation, micro-irrigation, drip irrigation and other water-saving irrigation methods, and the afforesting and irrigation system for gardens shall be strictly implemented so as to improve the proficiency of water for afforestation purposes.

Rainwater or recycled water shall be used as water for internal scenery and surroundings purposes of residential quarters and units and for other odd purposes in urban planning, and no tap water shall be used.

Article 23 Car-washing enterprises shall set up water-recycling facilities. Car-washing enterprises connected to the recycled water of an area which is covered by recycled water pipes shall use recycled water.

Article 24 It is prohibited to produce or sell highly water-consuming equipments and products declared obsolete by formal decree of the State or water-using utensils failing to pass the authentication for water-conservative products or to conform to the water-conservative standards of this Municipality.

The municipal department of water conservation administration shall, together with and the municipal administrative department of quality supervision and inspection, affirm the “list of water-saving utensils” and the “list of water-using utensils declared obsolete by formal decree”, and make them known to the public.

Article 25 The water-supplying units shall strengthen the maintenance and management of water-supplying pipes and networks, improve the level of monitoring, maintenance and management of the pipes and networks, and ensure that the rate of leakage or missing accords with the standards prescribed by the State.

The public water-supplying units shall make the telephone number of emergency repairs to the public, and conduct emergency repairs without delay when breakdowns happen.

Article 26 The departments of water conservation administration and relevant units shall set up real-time monitoring systems of water resources, resource optimizing configuration systems and systems of water-conservation information management, and improve the counting and reporting system of water-using information.

If the water used by a unit with a relatively larger capacity of water consumption may exceed the water-use quota, the department of water conservation administration shall provide early warning signals to it.

Article 27 A water-using unit shall take measures to strengthen the water conservation administration, and perform the following tasks well:

(1) establish and improve the responsibility system of water conservation;

(2) set up institutions specialized in water conservation and designate specific persons to take charge of the substantial work of water conservation;

(3) keep records and do counting and analyses on water-using, clarify the water-using plan, the objective of water conservation and the measures of water conservation, and make analyses on reasonable water-using or tests on water balance at regular intervals;

(4) strengthen the daily maintenance and management of water-saving facilities; and

(5) promote the publicity on water conservation.

Article 28 The news media shall strengthen the publicity of water conservation, and broadcast and publish public service advertisements on water conservation.

The competent administrative department of education shall include the knowledge of water conservation in the content of school education.

The travel agencies, while receiving guests, shall conduct water-conservation publicity so as to improve the water-conservation consciousness of the tourists.

Hotels, cinemas, sports fields and stadiums and other public places shall set up slogans publicizing the knowledge of water conservation.

Article 29 This Municipality shall pace up the work of setting up the development and promotion system of water-saving ion technologies and the research and production system of water-saving equipments and utensils.

The relevant governmental departments shall organize and launch the research on water-saving sciences and technologies and integrate the scientific resources on water conservation.

Units and individuals shall be encouraged to develop and manufacture water-saving residential water utensils and water-saving technologies, techniques, equipments and products.

Article 30 Units and individuals shall be encouraged to report water-wasting acts to the departments of water conservation administration or the law enforcement departments of water conservation, and the departments concerned shall, upon receiving such reports, investigate and handle the matters without delay.

The departments concerned that receive such reports shall maintain secrecy of the reporters and give rewards to those who have reported the truth and provided the main clues and evidences to the investigations on major water-wasting acts.

Article 31 The departments of water conservation administration shall strengthen the inspection on the water measurement facilities of the units that directly draw water from rivers, lakes or underground, and charge water resource fees on time. the water-supplying units shall improve water-using measurement and meter checking systems, accurately record the amount of water used and collect water fees on time.

The water-using units and individuals shall cooperate with the functionaries of the departments of water conservation administration and the water-supplying units in meter checking the charging of water fees.

Article 32 If anyone acts in violation of these Measures, the department of water conservation administration shall order him to stop illegal acts and rectify within a prescribed time limit and punish him according to the following provisions:

(1) where a water-supplying units and other units who directly draw water from rivers, lakes or underground fail to provide materials to the departments of water conservation administration in time or provide false materials, the units shall be fined 1,000 Yuan;

(2) where a unit directly discharges indirect cooling water or the rate of recycled usage is below 95%, it shall be fined not less than 1,000 Yuan nor more than 5,000 Yuan;

(3) where the water used for agricultural purpose is not measured or the flood irrigation causes water waste, the unit responsible shall be fined not more than 1,000 Yuan;

(4) where a unit changes the purpose of a well for agricultural use without authorization, it shall be fined not less than 20,000 Yuan nor more than 100,000 Yuan;

(5) where the water used for scenery surroundings in residential quarters and in units is tap water, the units responsible shall be fined not less than 1,000 Yuan nor more than 5,000 Yuan;

(6) where waste of water is caused because the water-using facilities, equipments or utensils are not properly repaired, maintained or managed, the units responsible shall be fined not less than 500 Yuan nor more than 1,000 Yuan for each flaw;

(7) where a water-using unit uses utensils declared obsolete by formal decree, it shall be fined 100 Yuan for each piece of such utensil; and

(8) where any unit draws water from public water-supplying facilities and fire-fighting facilities without authorization, it shall be fined not less than 10,000 Yuan nor more than 30,000 Yuan.

Article 33 Where a water-using unit acts in violation of Article 14 of these Measures and do not pay progressive price-plus fees on time, the department of water conservation administration shall order it to rectify within a prescribed time limit and charge an overdue fine of 0.2% of the overdue fees on a daily basis.

Article 34 Where a unit in charge of demolishing, while demolishing urban dwellings and relocating the residents, acts in violation of the first paragraph of Article 17 of these Measures and fails to sign an agreement with the water-supplying unit to stop supplying water or construct beyond the provisions of the agreement without authorization and causes a serious waste of water resources, it shall, in addition to paying the relevant fees, be fined by the department of water conservation administration an amount not less than one time nor more than five times of the due water fees.

Where a water-supplying units acts in violation of the second paragraph of Article 17 of these Measures and deliberately delay or refuse to sign an agreement to stop supplying water with the unit in charge of demolishing without justifiable reasons or fails to take timely measures to stop supplying water and causes a waste of water resources, it shall be ordered to rectify and fined not less than 1,000 Yuan nor more than 5,000 Yuan by the department of water conservation administration.

Article 35 If the public water-supplying pipes are damaged or squeezed in violation of regulations in the process of construction and causes a waste of water resources, the constructor shall be ordered to make rectify and fined not less than 1,000 Yuan nor more than 10,000 Yuan by the department of water conservation administration; in the event of any losses, the person responsible shall compensate for the losses according to law.

Article 36 Where the rate of productivity of an enterprise producing pure water is below 70% which is in violation of the fourth paragraph of Article 18 of these Measures, the department of water conservation administration shall order it to rectify within a prescribed time limit; where the enterprise still cannot reach the standard beyond the time limit, the department of water conservation administration shall examine and reduce its water-use quota; where the circumstances are serious, it shall cease to supply water according to law.

Article 37 Where any unit or individual acts in violation of Article 24 of these Measures and produces or sells utensils that do not conform to the standards on water conservation of this Municipality, the competent administrative department of quality supervision and inspection or the administrative departments of industrial and commercial administration shall, according to their specific functions and duties, order the unit or individual to stop the production and sale, and fine not less than 50 Yuan nor more than 100 Yuan for each set (piece or unit).

Article 38 The proceedings concerning the administrative punishments provided for in these Measures that shall be organized and implemented by the municipal supervisory body as determined by the Municipal People’s Government shall be organized and implemented by the municipal supervisory body..

Article 39 These Measures shall enter into force as of 1 May, 2005. The Measures of Beijing Municipality on Rewarding Urban Water Conservation Deeds promulgated by the Municipal People’s Government on 13 June, 1986, the Administrative Measures of Beijing Municipality on the Construction of Water-saving Facilities Together with the Main Structure in Construction Projects promulgated by the Municipal People’s Government on 21 September, 1988, the Administrative Measures of Beijing Municipality on the Charge of Plus-fees on Water Used Exceeding the Quotas approved by the Municipal People’s Government on 14 November, 1989, promulgated by the Municipal Administration Committee of Beijing Municipality on 30 November, 1989, and revised by the approval of the Municipal People’s Government on 23 March, 1994, the Rules of Punishment of Beijing Municipality on Urban Water-wasting Acts promulgated by No. 11 Decree of the Municipal People’s Government on 6 July, 1994, and the Several Measures of Beijing Municipality on Water Conservation promulgated by No. 66 Decree of the Municipal People’s Government on 1 December, 2000 shall be simultaneously repealed.
