Law on Administrative Councils of the Provinces

LAW NO.2 OF 1343


CONCERNING THE ADMINISTRATIVE COUNCILS


OF THE PROVINCES


28 Qaus 1343

ARTICLE 1: There is to be held in every (Afghan) province a Provincial Administration Council in accordance with this law.


ARTICLE 2: The Provincial Administrative Council is to be formed in the following manner:


  1. The Wali as the Chairman;
  2. The Assistant Wali as member;
  3. The Chief Accountant (Mustawfi) and other departmental chiefs, whose ranks are not less than Director, as members;
  4. The security commander as member.

ARTICLE 3: The Provincial Council holds meetings every Monday. The members of the Council are to sign, on meeting days, the Attendance Book at the Secretariat of Council.


ARTICLE 4: The Administrative Council can be held only when at least more than half of the members are present.


ARTICLE 5: The decisions of the Council are made by a majority of votes. The vote of the Chairmen is decisive when the votes are equal on both sides of a resolution.


ARTICLE 6: The correspondence (clerical affairs) of the Council is to be taken care of by the Administrative Directorate of the Province. The Administrative Director of the Province is to work also as the Secretary to the Council.


ARTICLE 7: The Provincial Administrative Council is to execute the duties which are given to the Advisory Council by the stated articles of the following laws:


  1. Article 4 of the Municipality Law,
  2. Article 14 of the Municipality Law,
  3. Article 42 of the Municipality Law,
  4. Article 50 of the Municipality Law, and
  5. Article 12 of the Livestock Tax Law.

ARTICLE 8: The Provincial Administrative Council can abolish the contract of the workers who have not performed the conditions of the agreement in accordance with Article (52) of the labor Law. In this case, the collection of remuneration for the loss is also among the responsibilities of the Council. This council is to execute also other tasks delegated it by other governmental laws.


ARTICLE 9: The lease and sale of the government properties in a province cannot be done without the consent of the Council. Installments of government dues, in cases where these are permitted by law, are also among the responsibilities and authorities of the Council.


ARTICLE 10: Every member of the Council may, with the permission of the chairman, consult with the members of the Council on a matter

ARTICLE 11: This law is in force after its publication in the Official Gazette.
